Prosecutors in Clark County, Nev. on Tuesday decided not to prosecute Blake Griffin on misdemeanor batter charges for allegedly slapping a man and taking his cell phone inside the Tao nightclub in Las Vegas in late October, the Associated Press reported.

District Attorney Steve Wolfson said that new information gathered on the incident indicates it would be difficult to prove Griffin’s guilt in court. The accuser was Daniel Schuman of West Hollywood.

Schuman had alleged that Griffin slapped him and took his cell phone after he took pictures of Griffin and Clippers teammates.

Griffin, 26, did not appear in court.
