The undersigned is informed and believes that:
COUNT 1
On or about April 26, 2007, in the County of Los Angeles, the crime of MURDER, in violation of PENAL CODE SECTION 187(a), a Felony, was committed by ERIC SANTANDER DELACRUZ and FERNANDO ROMERO, who did unlawfully, and with malice aforethought murder SONIA RIOS RISKEN, a human being.
"NOTICE: The above offense is a serious felony within the meaning of Penal Code Section 1192.7(c) and a violent felony within the meaning of Penal Code Section 667.5(c)."
It is further alleged that in the commission and attempted commission of the above offense a principal in said offense was armed with a firearm(s), to wit, 9mm, said arming not being an element of the above offense, within the meaning of Penal Code section 12022(a)(1).

COUNT 2
On or between January 6, 2007 and April 27, 2007, in the County of Los Angeles, the crime of CONSPIRACY TO COMMIT A CRIME, in violation of PENAL CODE SECTION 182(a)(1), a Felony, was committed by ERIC SANTANDER DELACRUZ and FERNANDO ROMERO, who did unlawfully conspire together and with another person and persons whose identity is unknown to commit the crime of Murder, in violation of Section 187(a) of the Penal Code, a felony; that pursuant to and for the purpose of carrying out the objectives and purposes of the aforesaid conspiracy, the said defendants committed the following overt act and acts at and in the County of Los Angeles: xxxxxxx.

NOTICE: Conviction of this offense will require the defendant to provide DNA samples and print impressions pursuant to Penal Code sections 296 and 296.1. Willful refusal to provide the samples and impressions is a crime.

circumstances in aggravation, pursuant to Penal Code section 1170(b) and
Cunningham v.
