From the cutting room floor: Cameron Brown murder retrial closing arguments - Part III

So, the jury now has the case. Let's see if I can get through this before there's a verdict!

Part I

Part II

  • When Brown picked Lauren up at school, he didn't go home to where his wife was (she was at home surfing the Internet for ways to get Lauren), but to Inspiration Point.
  • The person working the guard shack at the Abalone Cove parking lot said Lauren looked scared and something wasn't right.
  • Brown had a disposable camera with him on their trek, and took three photos of Lauren between the car and the playground on the beach, purportedly to show how "happy" Lauren was. Hum argued that was part of Brown's plan. "Does it really look like Lauren's having such a great time?"
  • Brown's story: After 20 minutes of playing at the playground, Lauren takes off hiking, "and we all know that is a flat-out lie because Lauren doesn't hike." Lauren was leading and Brown was having trouble keeping up because she was much too energetic. However, witnesses who saw them said otherwise and that isn't true because we know Brown was an outdoorsman in grat shape who biked an skiied, yet Lauren was a 4-year-old who had spent the day crying and hadn't even had her lunch.
  • One witness said he saw Lauren four to five feet behind Brown on the trail to Portugese Point.
  • Another witness said Lauren was quiet and he didn't see them talking. That same witness said he heard a short, sharp scream coming from the direction of Inspiration Point around 2:30 or 2:45 p.m. as he sat on Portugese Point. He contradicts Brown and has no reason to lie.
  • A third witness said he saw Brown and Lauren at the top of Portugese Point with Brown in front and Lauren trying to keep up. He sees them approximately three times. A regular to the area, the witness said he's never seen children in that area. "We've been out there, we know why."
  • A fourth witness was driving on Palos Verdes Boulevard and reported seeing Brown in front with Lauren following behind as they hiked along the road between Portugese Point toward Inspriation Point.
  • A defense witness said he saw Brown guiding Lauren up the trail as she struggled on all fours to get to Inspriation Point. "She didn't want to go up there. He directed her up there." The witness said "something's not right" to himself.
  • "Because he lied about everything heading up to that cliff, why would we believe what he says about how she went over?" His story is refuted by physics, the evidence and Lauren's injuries.
  • If Brown is lying about everything else, then we don't have to believe him when he says Lauren slipped and fell.

 

  • Sheriff's homicide Detective Jeff Leslie, the lead investigating officer, testified several times during the trial on various issues. What Brown told Leslie: Lauren led them out to Inspiration Point to look at the view (to which Hum asked - why not Portugese Point? Safer and with the same view? Because more people.)
  • Brown said he sat in the U-shaped area four-feet from the edge while Lauren ran around throwing rocks over the edge.
  • Brown told a friend he was looking around and didn't see how Lauren went over. She was there, then she was gone. He told Deputy Jessica Brothers the same thing.
  • Then Brown told Leslie he heard "oh" and saw Lauren falling forward and he could just see her feet as she falls off the cliff. This is "not consistent with common sense."
  • In the next version, Brown told Leslie he heard "uh-oh" and saw Lauren's left back side as she fell forward, arms out in front of her. "This is signifiantly different than the other two."
  • "If the defendant's telling the truth, those three versions should be consistent, and they're not."
  • Brown said he couldn't see Lauren after she fell, but told someone else from law enforcement or the fire department (not sure) that he looked over and saw Lauren floating in the water.
  • There is no explanation why he didn't yell down to the people on the beach below to call 911. Instead, Brown went down to the nude sunbathing beach and asked to use someone's phone.
  • While Brown told investigators he was crying on the 911 call, the tape of the 5 1/2 minute call proves he was lying. Brown sounds out of breath, but is telling the nude sunbathers they're going to have to "cover-up" and kinda "chuckles." He never says "hurry."
  • Then, he goes all the way back up and over Inspiration Point so he can have access to the area of water where Lauren was. When he gets there, he sees his daughter floating face down, but he takes off his clothes and shoes like he'd seen in "Baywatch" so that he doesn't have to wait around in wet clothes and be uncomfortable. "That's what he's thinking about - himself. And that's what he's always thinking about."
  • He pulls her out, says he tried to do CPR for about a minute, then flings off his wet underwear and gets dressed. He carries her up to the archery range and lies her on her back on the a picnic table.
  • By then, a little more than nine minutes has passed since she fell.
  • When the first responders arrive, he is "indifferent," "unemotional," "calm," "in control" and "normal." "Nobody has ever seen anything like this."
  • The defense brought in an expert to say people react differently to grief, and opined that Brown was "disassociating." "They do, but not like that." Firefighters and detectives said they never saw anybody react like that in this kind of situation.
  • Defendant talked about the election (this was during the whole Gore-Bush time) and complained about his wet boots.
  • "He sobs a couple times for show, and sighs."
  • He's concerned about the media that's arriving because he doesn't want Patti to find out what happened this way (but no mention of Key-Marer). He's concerned about his car and surfboard, left at the Abalone Cove parking lot.
  • "He just doesn't care about Lauren, all he cares about his himself."
  • During a three-hour interview with Leslie, Brown was "cold" and "indifferent." Leslie said usually parents or caregivers blame themselves. But Brown blamed Lauren. He is "selfish" and "self-centered." "I just followed her out there," he said.
