This photo would appear to be Passive Arts Studio owner John Lavine and his dog. Fired employee David Edward Albert allegedly shot him to death  set the building on fire. Lavine ran a bondage club on La Cienega in Lennox. The photo is on the club's MySpace site.

Here is the felony complaint filed today in court:

FELONY COMPLAINT
SUPERIOR COURT OF THE STATE OF CALIFORNIA
FOR THE COUNTY OF LOS ANGELES

    THE PEOPLE OF THE STATE OF CALIFORNIA,
Plaintiff,
    v.

    01 DAVID EDWARD ALBERT (11/04/1956)
Defendant(s).
    CASE NO. YA078696



    FELONY COMPLAINT

The undersigned is informed and believes that:

COUNT 1

On or about July 27, 2010, in the County of Los Angeles, the crime of MURDER, in violation of PENAL CODE SECTION 187(a), a Felony, was committed by DAVID EDWARD ALBERT, who did unlawfully, and with malice aforethought murder JOHN LAVINE, a human being.
"NOTICE: The above offense is a serious felony within the meaning of Penal Code Section 1192.7(c) and a violent felony within the meaning of Penal Code Section 667.5(c)."


It is further alleged that said defendant(s), DAVID EDWARD ALBERT personally and intentionally discharged a firearm, a handgun , which caused great bodily injury and death to JOHN LAVINE within the meaning of Penal Code Section 12022.53(d) also causing the above offense to become a serious felony pursuant to Penal Code section 1192.7(c)(8) and a violent felony within the meaning of Penal Code section 667.6(c)(8).
It is further alleged that said defendant(s), DAVID EDWARD ALBERT personally and intentionally discharged a firearm, a handgun , within the meaning of Penal Code Section 12022.53(c) also causing the above offense to become a serious felony pursuant to Penal Code section 1192.7(c)(8) and a violent felony within the meaning of Penal Code section 667.5(c)(8).
It is further alleged that said defendant(s), DAVID EDWARD ALBERT personally used a firearm, a handgun , within the meaning of Penal Code Section 12022.53(b) also causing the above offense to become a serious felony pursuant to Penal Code section 1192.7(c)(8) and a violent felony within the meaning of Penal Code section 667.5(c)(8).

COUNT 2

On or about July 27, 2010, in the County of Los Angeles, the crime of ARSON OF A STRUCTURE OR FOREST, in violation of PENAL CODE SECTION 451(c), a Felony, was committed by DAVID EDWARD ALBERT, who did willfully, unlawfully, and maliciously set fire to and burn and cause to be burned a structure and forest land located at 10914 S. LA CIENEGA BLVD., LOS ANGELES.
"NOTICE: The above offense is a serious felony within the meaning of Penal Code section 1192.7(c)."

COUNT 3

On or about July 27, 2010, in the County of Los Angeles, the crime of CRUELTY TO AN ANIMAL, in violation of PENAL CODE SECTION 597(a), a Felony, was committed by DAVID EDWARD ALBERT, who did unlawfully, maliciously and intentionally KILLED AN ANIMAL, TO WIT, A DOG.

NOTICE: Conviction of this offense will require the defendant to provide DNA samples and print impressions pursuant to Penal Code sections 296 and 296.1. Willful refusal to provide the samples and impressions is a crime.

NOTICE: The People of the State of California intend to present evidence and seek jury findings regarding all applicable circumstances in aggravation, pursuant to Penal Code section 1170(b) and Cunningham v. California 2007 U.S. LEXIS 1324.

NOTICE: A Suspected Child Abuse Report (SCAR) may have been generated within the meaning of Penal Code §§ 11166 and 11168 involving the charges alleged in this complaint. Dissemination of a SCAR is limited by Penal Code §§ 11167 and 11167.5 and a court order is required for full disclosure of the contents of a SCAR.
