You Can't Advertise That!

David Bernstein has an interesting post at The Volokh Conspiracy about how housing laws could destroy Craig's List... and the ability of minorities to find the roommates they want.

I think some of the complaints were legit. It's not right to advertise something that is directly offensive and targeted a certain group. The ad's that said stuff like "No minorities allowed" are doing exactly that. The people advertising are singling out a particular sector of society and basically telling them to keep reading because they are not welcome for this ad. It's back to the segregation days. But, I don't see how saying an apartment with a temple around the corner is offensive. They are not saying that if you don't go to temple, you can't live in this apartment. They are simply stating a fact that could or could not be useful in choosing an apartment. Some people may want to live next to a temple. Others may not. They leave it up to the readers to decide. They are not telling people what to do. So, I agree some of the ads are offensive and shouldn't be posted. But I don't think shutting down the site is necessary. They simply need to weed out the ads that are directly targeted to offend certain types of people.
