Hernandez suffered gunshot wounds as the driver of a Chrylser Sebring that crashed head-on into a Toyota pickup about 3 a.m. in July 2002 near Cedar and Slover avenues in Fontana.
The driver's cousin, Christopher Paul Figueroa, was a passenger and has told police he blacked out. When he regained consciousness, Figueroa told detectives he was outside the car and emergency personnel were there.
For years, no one was charged in the case. But in May 2008, prosecutors in the county's Cold Case Unit filed charges against Figueroa based on gunshot residue evidence.
The defendant returns to court May 5 to be formally arraigned on charges of murder and attempted murder. His bail remains at $2 million.
In a statement to detectives, Figueroa said he and Hernandez went to a store to buy cigarettes after drinking beer and socializing at a relative's house, Sheriff's detective Robert Alexander testified.
At the store, Figueroa asked some girls where to get methamphetamine and the pair followed them to a Bloomington house. When the drug buy took too long, he and Hernandez left, Figueroa said.
"As they were leaving, a car started following them, and a chase ensued," Alexander testified that Figueroa told him. The defendant insisted he blacked out in the crash.
The defense argued that Hernandez was shot by someone else through the car's passenger window. Prosecutor John Thomas countered, during the court proceedings, that two witnesses testified that they didn't see any vehicles on the passenger side of the Sebring.
Thomas also argued there were was a lack of bullet holes and evidence of a chase, such as skidmarks.
The defense explained that Figueroa could have gotten gunshot residue particles when the bullet passed through the window or while he was in a patrol car.
