Men plead not guilty to murder charges

Two men charged with murder for a December shooting death pleaded not guilty to criminal charges this morning in Pomona Superior Court.

Albert Matthew Sandoval, 21, and Jose Luis Gutierrez, 16, are accused of killing 24-year-old Miguel Martin on Dec. 5, 2008 in a market parking lot in the 1100 block of West Mission Boulevard.

A jury trial in the case was set for July 29.

Two alleged Pomona gang members have been ordered to stand trial for the December murder of Miguel Martin, 24.

Jose Luis Gutierrez, 16, is accused of shooting and killing Martin on Dec. 5 in the parking lot of Guadalajara Market, 1134 W. Mission Blvd. Prosecutors have charged Gutierrez as an adult.

Albert Matthew Sandoval, 21, is accused of dropping off Gutierrez near the market for the purposes of killing Martin.

After hearing testimony from five witnesses Wednesday during a preliminary hearing in Pomona Superior Court, Judge Charles Horan ruled that Gutierrez and Sandoval must stand trial on murder charges.

Horan also held the men to answer on allegations that the murder was committed for the benefit of a street gang, said Deputy District Attorney Bjorn Dodd, the prosecutor assigned to the case.

Both men potentially face 50 years to life in prison, and Gutierrez may face more time because of the gang enhancement, Dodd said.

Dodd said that Martin and some of his family members had been harassed and intimidated in the past by a street gang that Gutierrez and Sandoval were members of.

The day of the shooting, friends of Gutierrez and Sandoval got into an argument with Martin in front of Martin's home, Dodd said.

The five witnesses at last week's preliminary hearing included two Pomona police detectives, two people who witnessed the shooting, and a relative of Martin who was familiar with the ongoing disagreements between Martin's family and the street gang, Dodd said.

Gutierrez and Sandoval are next due in court Feb. 26.

Two men pleaded not guilty last week to charges that they murdered Miguel Martin, 24, in front of a Mission Boulevard market on Dec. 5.

The alleged gunman, 16-year-old Jose Luis Gutierrez, and alleged accomplice Albert Matthew Sandoval, 21, are now scheduled to face a preliminary hearing on Feb. 11, said Deputy District Attorney Bjorn Dodd.

The two men entered their pleas Thursday in Pomona Superior Court. Both remain jailed in lieu of bail.

Dodd said the killing may have been motivated by a confrontation the morning of the shooting between Martin and friends of the accused men.

Gutierrez allegedly shot Martin at about 5 p.m. in the parking lot of Guadalajara Market, 1134 W. Mission Blvd.

Arraignment postponed for Dec. 5 Pomona murder suspects

An arraignment hearing was postponed Monday for two Pomona men accused of murdering 24-year-old Miguel Martin on Dec. 5.

Jose Luis Gutierrez, 16, and Albert Matthew Sandoval, 21, appeared in Pomona Superior Court Monday but did not enter a plea. Their arraignment was rescheduled for Jan. 15.

The morning of his death, Martin got into an argument with two of Gutierrez and Sandoval's associates, prosecutors said.

Later that day, Gutierrez and Sandoval saw Martin in a market parking lot on Mission Avenue.

Gutierrez dropped Sandoval off, and Sadoval shot Martin to death, prosecutors said.

Prosecutors filed charges Tuesday against two Pomona residents arrested on suspicion of murder for the Friday shooting death of Miguel Martin, 24.

Jose Luis Gutierrez, the 16-year-old boy who allegedly pulled the trigger during the shooting, has been charged as an adult.

Albert Matthew Sandoval, 21, dropped off Gutierrez near a Mission Avenue market for the purposes of shooting Martin, of Pomona, Deputy District Attorney Bjorn Dodd said Wednesday.

Dodd said both men were in Pomona Superior Court Tuesday for an arraignment hearing, but they did not enter pleas. The hearing was postponed to Dec. 22.

The shooting may have been triggered by a verbal confrontation earlier Friday between Martin and two of the accused men's friends, Dodd said.
