San Bernardino man sentenced for killing brother
A San Bernardino man convicted of charging into his younger brother's apartment and fatally shooting him in 2007 was sentenced to 50 years to life in state prison today.
Prosecutors say an ongoing dispute between the brothers reached a deadly peak when Louis Jefferson Crosby let himself into his brother's Date Street apartment in July 2007, aimed a gun and fired at 26-year-old Avery John Crosby.
Louis Crosby, 38, was sentenced before Judge Arthur Harrison in San Bernardino Superior Court, as family members wept in the gallery.
A jury found the defendant guilty on July 24 of first-degree murder and an allegation that he personally and intentionally fired a gun at his brother, according to court records. Crosby's lawyer, Richard Farquhar, told the court he will file a notice of intent to appeal the conviction.
The defense withdrew a motion for a new trial just prior to the sentencing proceedings. Issues that would have been addressed in the motion will be handled at the appellate level, Farquhar said.
Deputy District Attorney David Tulcan objected to the withdrawal of the motion, but the court allowed the defense's request.
Upon receiving word of the shooting, San Bernardino Police were dispatched to the Sunset Ridge apartments, in the 1700 block of East Date Street, at 11:52 p.m. and found Avery Crosby bleeding from a gunshot wound. He was taken to Loma Linda University Medical Center, where he later died.
The brothers are originally from the Los Angeles area.
