AQMD, 99 Ranch reach agreement
It appears that 99 Ranch and the South Coast Air Quality Management District have agreed on a plan to quell cooking odors that have irritated nearby residents. In the next hour, the market and AQMD staff members will testify to the Hearing Board about the odor control equipment that the market will install.
"The district is comfortable that this course of action has been chosen to improve this problem," said Karin Manwaring, the attorney representing AQMD.
If this is so, fried fish and chow mein could return to the Base Line Road market soon.

Wendy, is there a next hearing or follow up? Seeing the time posted on the blog... so you're blogging while at the hearing? I submitted a letter to the board asking if market can be declared a nuisance without quantifiable objective standard such as measurement of discharge particulates, chemical concentrations, etc etc, one cannot quantify what is a nuisance. Throughout all the inspection, the subject human nose is utilized. Stinky tofu smells good to some smells foul to others. Being an engineer, i deal alot with quantitative evidence more so than qualitative. I feel that not one bit of quantitative evidence was provided even though AQMD is a regulatory agency that deals with many quantitative issues such as measurable emmissions. Having a large engineering staff, shouldn't they insist a baseline be measured to compared to a future result?
For now, there isn't a follow-up hearing planned, Andy. AQMD will continue to monitor the situation and make sure the equipment works but the hearing board is not scheduled to meet again on this topic.

On your other points, I'd refer to my previous blog entry "What's a nuisance, anyway?" (http://www.insidesocal.com/rcnow/2011/06/whats-a-nuisance-anyway.html) A public nuisance is defined by a smell that annoys a significant group of people. By that definition, the board felt 99 Ranch was at fault.
