Mynisha defendants in court Wednesday
Four men charged with the deadly shooting of Mynisha Crenshaw are set to appear in court Wednesday, when a judge is expected to decide whether a re-trial gets a green light to get started.
The defendants -- Sidikiba Greenwood, Sinque Morrison, Michael Barnett Jr., and Harold Phillips -- are scheduled to appear at 1:30 p.m. in Dept. S19 in San Bernardino Superior Court.
Prosecutor Ron Webster announced that he was ready for the re-trial at a hearing on Oct. 3. The re-trial was scheduled to begin on Oct. 1, according to court records.
But Judge Michael Smith provided a short continuance because the defense lawyer for Phillips may be engaged in another trial in Riverside Superior Court.
Smith is expected to consider Wednesday whether a longer delay is needed in the Mynisha re-trial or look at other options. Morrison's lawyer, James Terrell, has informed the court that his client is against waiving more time and wants to invoke his speedy trial rights.
A jury deadlocked on most of the charges against the four defendants in West Valley Superior Court last fall.
San Bernardino Police reported the four were part of a larger group of armed gang members and associates who went to a San Bernardino apartment complex on Nov. 13, 2005 to retaliate against a rival street gang.
Gunshots were fired into an apartment where Mynisha and her family were eating dinner. Mynisha was struck once in the chest and later died. Her older sister was seriously wounded in the arm.
Prosecutors have said the victims' family had no ties to street gangs.
