Update: Narcotics defendant faces prison time for violation

A defendant awaiting sentencing on her arrest during a major San Bernardino narcotics sweep in 2006 may get even more prison time, instead of the probation she expected to receive, for violating a waiver that granted her release from custody pending sentencing.

Janette Amaya, 51, was scheduled to be sentenced today on a plea bargain she made with prosecutors in the narcotics case aimed at the Mexican Mafia prison gang, and she was expected to get only five years of probation.

But on June 12, Amaya was arrested during a traffic stop in San Bernardino where police found drugs and money, and she now faces up to eight years and eight months in state prison, according to the District Attorney's Office.

During an appearance today in San Bernardino Superior Court, Amaya turned down an offer from the court of six years in prison, and a hearing was set for Sept. 18 to discuss the alleged waiver violation, according to Deputy District Attorney Douglas Poston.

Prosecutors say they plan to file special allegations that will increase Amaya's possible prison time in her new case from the traffic stop.

"I'm going file the appropriate special allegations that will increase her exposure on the most recently filed case to 14 years," Poston said, via a telephone conversation.

Two other defendants in the case, Salvador Hernandez, 43, and his brother Alfred Hernandez, 39, are set for sentencing Friday, according to Superior Court records.

Defendants and San Manuel tribal members Stacy Barajas-Nunez, 25, and her brother Erik Barajas, 35, are set to be sentenced Nov. 6.

The defendants were among more than 40 people who were arrested as a result of the seven-month investigation and sweep across the city in December 2006, according to San Bernardino Police.
