Lawsuit to be filed in death of Highland boy by sheriff's deputy

An attorney representing the mother of a 14-year-old Highland boy killed after he was struck by a sheriff's deputy's patrol car in August plans to file a lawsuit against the city of Highland, the San Bernardino County Sheriff's Department and the county no later than Friday.

The city and county have rejected a claim, the predecessor to a lawsuit, filed by San Bernardino attorney Mark McDonald in September. McDonald represents Stacey McCombs, mother of 14-year-old Justin Taylor Ames, who was struck by an unnamed Highland sheriff's deputy at the intersection of Ninth Street and Drummond Avenue on Aug. 22.

This much is fact: Two deputies responding to a disturbance call in the area passed through the intersection where Justin was struck. Justin and a friend were riding their bicycles south on Drummond Avenue about 6:30 p.m. The two deputies were headed west down Ninth Street.

One of the patrol cars, which didn't have its lights or siren on, collided with Justin, who was not wearing a helmet when he rode into the intersection.

At least one witness said the boys did not stop at the intersection, and the deputy didn't have time to stop.

But other witnesses say the deputy was at fault, and actually accelerated prior to the collision, perhaps due to being blinded by the sun and not seeing the boy, said paralegal Denise McDonald, who is assisting Mark McDonald in the litigation.

The boy who was with Justin at the time of collision was never interviewed at length by sheriff's investigators, she said.

yes it is sad a young life was shortened because of an accident but time after time someone always wants money because the death of a loved one... maybe that loved one could have been saved if the parent actually took precautions to make the teen wear a helmet even if it didn't look cool it could have saved his young life.

Parents lose their children and first thing they want is money to replace the loved one. Parents that ignorant shouldn't be thinking about money, they should be praying for the loss of a loved one. Educating children is NOT just a responsibility of schools, but the parents also.

cops often abuse their power and do not lead by example. cops often drive reckless regardless whether their is an emergency or not. as far as the cop not having sirens to warn pedestrians (who were crossing at an intersection) he is at fault hands down. And as far as the last comment mentioning it being ironic that people expect money for their child's death, isn't it also ironic that the county's first response is that they are not at fault.

Justin wasnt only my life long friend he was my brother ive known him since i was 3 me and him were best friends the day justin got hit i was visiting my ex's house and i came home to hear the worst news i will ever take my mentor and friend also a friend of mine and justins came over and told me that justin was hit by a petrol car near his house at first i thought he was kidding then he ask me if i wanted to go to the hospitle to see him and when i did i entered the the doors of the hospitle i started to tear then i saw justin a couple stories high i went to his room and collapsed i fell to the ground my heart felt like it was torn out of my chest mom aka stacey (justins mom) and his step dad had to pick me up and set me in a chair i lost one of the only things that mattered to me a few nights later aprox. 1:00 at night stacey called me and i had lost him i didnt sleep all night for about a week i didnt eat or sleep he was my best friend my brother and i will never forget him

Some of the people who left these comments need a new view on life. Justin's family looked for money not because the loss of Justin was not huge but it is because the funeral costs and medical bills where huge. Yes Justin should have had a helmet but that officer should have his badge taken. I am a daughter of a police officer and police officers must have their lights and sirens on if they are going to go over the speed limit. there is no excuse for the officers actions. I can not believe some of the people on here are surprised Stacey filed a lawsuit. How else could she pay to put her son to rest. Justin was an amazing person. And he is greatly missed
