Trial in freeway battery death may begin next week
A trial may be coming soon for a San Bernardino man charged in a rollover collision that launched a vehicle battery into opposing traffic on the 215 Freeway, killing a motorist.
Lawyers in the case of Kevin Harville announced they were ready for trial during proceedings today in San Bernardino Superior Court.
Harville returns to court Wednesday. If Deputy District Attorney Terry Brown and Deputy Public Defender Rod Curbelo remain ready, then Harville's trial will begin Thursday, according to Judge Bryan Foster.
Jury selection in the estimated two-week trial would also begin Thursday.
Harville pulled up alongside a Ford Expedition driven by his ex-girlfriend at a traffic light at Base Line and H streets on Oct. 24, 2006, and tried to get the woman's attention, according to the California Highway Patrol.
The defendant reportedly yelled at the woman, and she was just trying to get away from him, according to earlier court testimony. Witnesses told authorities that Harville's Ford Explorer bumped and rammed the woman's vehicle multiple times as they got on southbound 215 Freeway and continued south.
Hill stopped her Expedition after the Explorer cut her off. But Harville lost control, struck the guardrail and rolled over several times near Mill Street.
Among the car parts and debris flying into the northbound traffic lanes was the vehicle's battery, which slammed through the windshield of a truck being driven by 30-year-old Shawn Billings Kettlewell, according to the CHP.
Kettlewell later died from the his injuries.
Harville had prior violent run-ins with his ex-girlfriend leading up to the collision that killed Kettlewell, according to the CHP.
