Verdicts reached in 2005 death of Jerry Ramirez in San Bernardino
A jury has found one man guilty and deadlocked on charges against another in a second trial stemming from the shovel beating and deadly shooting of 22-year-old Jerry Ramirez in November 2005.
Jurors found defendant Edward Vincent Hernandez, 28, guilty of first-degree murder, conspiracy to commit murder and special allegations for using a gun, prosecutors confirmed.
The verdicts were announced Tuesday in San Bernardino Superior Court.
However, jurors hung 8-4 on a murder count for Hernandez's father, 50-year-old Edward Hernandez, said his lawyer James Crawford. The lawyer said he did not know which way, guilty or not guilty, the vote favored.
Edward Hernandez now has two hung juries in two trials on murder charges in connection with Ramirez's death. He was acquitted of a conspiracy charge at a trial in July, where jurors first deadlocked on the murder count.
Crawford maintains his client was not involved in the death and was instead painting inside his home at the time.
Deputy District Attorney Karen Khim said her office had not yet determined how it would proceed on the elder Hernandez, who returns to court Oct. 27.
Sentencing for Edward Vincent Hernandez is set for Dec. 4.
The District Attorney's Office had charged the defendants, and two other men, Benjamin Hernandez and Alfred Rodriguez, with Ramirez's death. The victim's body was found by authorities dumped in Waterman Canyon with several gunshot wounds to the head on Nov. 20, 2005.
Prosecutors say Ramirez was brazenly beaten multiple times with a shovel in a carport at an East Pumalo Street residence about noon on Nov. 18, 2005. Still alive after the beating, Ramirez was rolled up in blankets, put into the trunk of a car and taken from the home, according to earlier court testimony.
Co-defendants Benjamin Hernandez, 52, and Alfred Ray Rodriguez, 21, were convicted earlier this year and sentenced in August.
The brother of Edward Hernandez, Benjamin Hernandez was sentenced to 16 years to life in state prison, while Rodriguez got 15 years to life, according to Superior Court records.

Every body deserve a second chance in life maybe alfred rodriguez did not wanted to do crime it was just he was in the wrong place at wrong time.
