Deportation looms for Ontario man accused of sexual abuse
An Ontario man accused of sexually abusing three young children agreed to plead guilty to a felony sexual battery charge Friday and is expected to be deported to Mexico.
Rafael Rodriguez Valadez, 32, managed to avoid prison time as part of his plea agreement, an arrangement that his prosecutor partly attributed to the relative weakness of evidence against Valadez.
Deputy District Attorney Jason Anderson said most of the alleged abuse incidents happened several years ago, and the alleged victims have difficultly remembering details of the incidents.
Anderson said he was satisfied with the result because Valadez was forced to register as a sex offender, and a felony conviction makes it unlikely that Valadez will be permitted to re-enter the U.S.
"Because of status as an illegal immigrant ... he's not going to be here in this community," Anderson said.
At a June preliminary hearing at West Valley Superior Court, two young girls testified that Valadez sexually abused them repeatedly at his Ontario home, according to a transcript of the proceeding.
One of the girls testified that the abuse began when she was only 3 or 4 years old, and lasted about six years.
She said she didn't tell anyone about the abuse because Valadez said repeatedly that he would kill one of her family members if she did.
According to the felony complaint, the instances of abuse happened between January 2003 and March 2006.
An Ontario police officer also testified that he interviewed a young boy who accused Valadez of repeated sexual abuse.
After the preliminary hearing, Valadez was held to answer on five felony counts of lewd or lascivious acts with a child under 14.
The five charges each carried prison terms of up to 8 years, and each count also included a sentencing enhancement that could have resulted in a life sentence for Valadez.
As part of his plea agreement, Valadez was sentenced to 365 days in jail, but credited for 365 days in custody. Anderson said Valadez was likely deported over the weekend.
