Hearing continues for Luque in San Bernardino double homicide
Witness testimony continued today in the preliminary hearing for Javier Joaquin Luque who is charged with two shooting deaths in unincorporated San Bernardino in 2006.
A woman who was reportedly in the backseat of an SUV with Luque when deadly gunshots were fired at Ronald Jaramillo and Elizabeth Amaya continued her testimony from Nov. 6, when the hearing first began in San Bernardino Superior Court.
Luque faces charges in the deaths of driver Jaramillo and front passenger Amaya, both of San Bernardino, who were shot in a Chevrolet SUV on First Avenue near 40th Street in unincorporated San Bernardino on Sept. 6, 2006.
Jaramillo, 35, was driving, and Amaya, 30, was in the Tahoe's rear seat when the gunfire erupted, according to the San Bernardino County Sheriff's Department.
The witness testified, under cross-examination, that she was positive no one else was in the back seat of the vehicle except for her and Luque when the gunshots were fired. She also said she never talked with Luque about the shooting afterward.
San Bernardino Police gang officer Mike Martinez also testified about how the shootings were committed to benefit a local street gang because a "green light," leading to a hit, had been ordered for Jaramillo by gang higher-ups, according to prosecutors.
The preliminary hearing was scheduled to resume Nov. 25, when Judge Arthur Harrison is expected to rule whether there is sufficient evidence to hold Luque for trial on the charges.
In addition to the murder charges, Luque faces charges of using a firearm, a gang enhancement and the special circumstance of committing multiple murders, prosecutors said. Luque denied the charges.
The special circumstances make the case eligible for the death penalty; however, prosecutors have not yet announced whether they will seek it.
Luque was convicted in April and recently sentenced to 32 years in state prison in a separate carjacking case. He also faces charges of identity theft and incest in a third case.
