Ontario man must stand trial on charges of rape, sex with underage girls

A West Valley Superior Court judge ruled Tuesday that a 28-year-old Ontario man must stand trial on charges that he raped a 14-year-old girl and had a sexual relationship with a 16-year-old girl.

Both girls testified during Tuesday morning's preliminary hearing for Rudy Dalton Beltran, who is charged with seven felony crimes and potentially faces more than 20 years in prison.

The 14-year-old girl, identified in court as Jane Doe #1, said she met Beltran in July at the Lamplighter Ontario mobile-home park on Fourth Street, where she and the other alleged victim live across the street from each other.

The girl, now 15, said she and Beltran talked about their lives and kissed each other when they hung out twice that month.

The night they met, Beltran had gotten into an argument with the 16-year-old girl's grandmother, the girl said. Beltran told her he was 19 years old, she said.

She also said there was a night he came over to her home, but she said she didn't remember what happened because she had smoked marijuana earlier that night.

On July 31 at about 3 a.m., the girl said she woke up because she heard noise in her bedroom.

"I heard someone walking in my room, because he had stepped on a plastic bag or something, and it woke me up," she said.

She said she sat up in bed and saw Beltran. She said she screamed briefly but stopped because she didn't want to wake her father and brother, who were asleep in different rooms of the four-bedroom trailer.

She said Beltran had climbed through an open window into her bedroom.

She told Beltran to stop after he began making sexual advances, but he did not respond to her comments, she testified.

"I was just laying there looking at the ceiling, in shock pretty much," she said.

She said Beltran raped and sodomized her for about 30 minutes. After Beltran left her room, she said she found part of a condom wrapper on the floor.

After about an hour of testimony, Jane Doe #1 was excused from the witness stand and Jane Doe #2, Beltran's former 16-year-old girlfriend, testified for about 25 minutes.

The girl said she and Beltran dated from about January 2008 to July 2008, and had consensual sex about every other day from February on.

When they met, Beltran told her he was 22 years old, she said.

During her testimony, the girl, now 17, said that she and Beltran had anal sex one time as well.
After the hearing, Deputy District Attorney Karen Schmauss said she would likely file an additional felony charge against Beltran for sodomy with a person under 18 years old.

Schmauss also said she might file additional charges of unlawful sexual intercourse with a minor because of the second alleged victim's testimony that she and Beltran had frequent sex.

At the end of the hearing, Judge Michael Libutti ruled that Beltran must stand trial on all seven charges filed against him by prosecutors.

Before testimony began at the hearing, Beltran formally rejected a plea bargain from the prosecution that would have included a 5-year, 4-month prison sentence. Schmauss said the plea offer to Beltran was withdrawn.

If convicted on all counts, he faces a prison sentence of up to 22 years and 8 months, Schmauss said. That number could rise if Schmauss files additional charges against Beltran.

Beltran is scheduled to return to West Valley Superior Court Dec. 4 for an arraignment hearing.

The hearing also included testimony from Ontario police Officer Timothy Glisson, who said Beltran drove to Mt. Baldy and threatened to jump off a cliff after police tried to arrest him on Aug. 5.

Beltran was talked down from a ledge and arrested after a five-hour standoff, Glisson said.
