Prosecutors file charges in Friday's Pomona slaying; 16-year-old shooter charged as adult
Prosecutors filed charges Tuesday against two Pomona residents arrested on suspicion of murder for the Friday shooting death of Miguel Martin, 24.
Jose Luis Gutierrez, the 16-year-old boy who allegedly pulled the trigger during the shooting, has been charged as an adult.
Albert Matthew Sandoval, 21, dropped off Gutierrez near a Mission Avenue market for the purposes of shooting Martin, of Pomona, Deputy District Attorney Bjorn Dodd said Wednesday.
Dodd said both men were in Pomona Superior Court Tuesday for an arraignment hearing, but they did not enter pleas. The hearing was postponed to Dec. 22.
The shooting may have been triggered by a verbal confrontation earlier Friday between Martin and two of the accused men's friends, Dodd said.
Martin was mowing his front lawn during the confrontation. He told his brother about the incident before he was shot to death later that day, Dodd said.
Shortly before 5 p.m., Martin walked to Guadalajara Market at 1134 W. Mission Blvd to buy cigarettes, Dodd said.
He was spotted there by Gutierrez and Sandoval, who just happened to be driving down Mission. Sandoval dropped Gutierrez off near the market, Dodd said.
Witnesses told police that Gutierrez fired four or five shots at Martin, fatally wounding him, then ran across Mission and got back into Sandoval's car, Dodd said.
Some of the witnesses recognized the two accused men and identified them in interviews with police, Dodd said.
"(Martin) was about two blocks from his house when he got shot," Dodd said.
Dodd said that Martin's family had previous problems with the "crew" of friends that included Gutierrez and Sandoval. Dodd said Martin's house had been shot at.
Both accused men were arrested at about 10 p.m. Saturday after Pomona police saw them driving together on Eighth Street, according to a police news release.
Dodd said both men spoke to police after they were arrested, but he declined to go into detail about what they said.
Bail was set at $2 million for Gutierrez, and at $1 million for Sandoval, Dodd said. Both men remain in custody.
They each face a potential prison sentence of up to 50 years to life, Dodd said.
