Three sentenced in Foothill Villas shooting in SB

Three men who were involved in a deadly gang shooting in San Bernardino, which was possibly sparked by the rebuff of a marijuana request, were each sentenced Friday to seven years in state prison.

Donte Lazon Mack, his brother Dorian Lavonn Mack, and Chrystopher Lamarr Young were sentenced in San Bernardino Superior Court under the terms of plea bargains they reached with prosecutors Dec. 23.

In those agreements, each of the men pleaded guilty to one count of assault with a firearm and a street gang enhancement in the slaying of Devin Tervelle McDavis, according to court records.

Donte and Dorian Mack, both 22, were credited with 781 days already served, including conduct credit. Young, 23, received 804 days credit.

Prosecutors originally charged the three defendants with murder and street gang allegations in the Aug. 11, 2008 shooting at the Foothill Villas apartments on West Second Street in San Bernardino.

McDavis, 26, of Fontana, and two others were smoking marijuana at Nicholson Park when another man asked for some, according to prosecutors. McDavis didn't share and an argument ensued.

Witnesses later identified the defendants to police and told officers they got in a fight with McDavis at the apartments when gunshots were fired.

Police arrived about 1:47 p.m. and found McDavis with gunshot wounds to his head and torso. He was taken to Arrowhead Regional Medical Center in Colton, where he died.
