City seeks injunction to shut down Hudson Theater

SAN BERNARDINO - The City Attorney's Office has filed a motion asking a judge for a preliminary injunction to halt activities at the Hudson Theater.
San Bernardino Superior Court Judge Janet Frangie is scheduled to hear the city's request March 10.
Police and city officials say the nightclub at 295 E. Caroline St. strains public resources and attracts drug deals and violence, including a homicide and a near riot last year.
From August 2008 to August 2009, police and fire personnel responded to more than 280 calls at the entertainment venue, "far more than any other single location in the city," according to court documents filed by the city.
The city issued a number of citations for alcohol violations, excessive noise and curfew violations from July 2008 to August 2009, documents state. But the problems have persisted, forcing the city to seek a preliminary injunction as "a last-ditch effort" to stop events from being held pending a trial, said Jolena Grider, senior deputy city attorney.
Roger Jon Diamond, an attorney representing the theater, said the city is wasting money by seeking a preliminary injunction rather than going straight to trial.
"The trial format is a much better way of learning the truth," Diamond said. "You have to have witnesses testify in person subject to cross examination."
Diamond accused City Attorney James F. Penman of trying to shut down a business that "employs people, pays taxes, pays rent and is part of the economy."
Penman said the theater is not a legitimate small business, adding that the city can't afford to delay taking action.
"We need to move on this," Penman said. "We need to solve the problem."



preliminary injunction would make the Hudson stop their events before they get a trial. What happened to innocent until proven guilty? Have our law makers forgotten about our little constitution again.

why close down the hudson when u do that
their will be alot of teens with nothing to do
on fridays n the'll just go cause trouble
in the streets if u ask me the hudson is a good
place to have teens go to so that the'll have something
to do
dontt close the hudson theater. theres no need for that..
if you close hudson theres more places teens are gonna go and do stupid things.. like on the streets... theres gonna be way more calls all around the I.E if they close the hudson... teens are gonna be on the streets with nothing to do.. & more violence its gonna happen.. just get more security..period.
Closing down the Hudson would only cause teens to go out into the streets and look for trouble and cause trouble. they will still party, they would look for another place like have house partys, warehouse partys, etc. The Hudson is a good place for teens, all it needs is more security, more lighting in the parking lot and a few more rules. Also with the securiy guards they need good training and a little more commen since because the drug dealers can pay them to get by and its not all securtiy guards just about 3 of them.
