Deputy accused in road-rage threats found not guilty

Thumbnail image for Heverly mug.jpgINDIO -- A jury found a San Bernardino County sheriff's deputy not guilty today of four felonies filed in connection with an alleged off-duty road-rage incident in which the deputy held a gun to another driver's head, a prosecutor said.

Richard Charles Heverly, 43, of La Verne, was accused of threatening to kill a tow truck driver who blocked a lane on the 10 Freeway about 50 miles east of Indio to divert traffic around a burning freight truck.

Prosecutors accused Heverly of abusing his police power during the Aug. 10, 2008 incident, while Heverly's defense attorney said the deputy was trying to manage traffic and used his gun lawfully.

The jury of seven women and five men deliberated about two and a half days at Larson Justice Center in Indio before reaching their verdicts.

Heverly works at West Valley Detention Center in Rancho Cucamonga. He was hired by the sheriff's department in 2006.
