SAN BERNARDINO - Despite millions in new police spending, intense public interest and innovative strategies, local crime is again on the rise.
Police recorded 892 violent crimes from Jan. 1 to May 30, a 6.2 percent increase over the same five-month period in 2006 ...

Last week, this reporter cleared the murkiness, again, by showing with UCR stats that although crime was down sharply in 2006 from 2005, nearly every category is up in 2007 from 2006.
Overall, violent crime is up more than 5 percent from last year.
But there is another set of stats of interest, particularly so in the context of the uptick in crime.
Arrests are down by about the same rate that crime is up.
Through August 2007, when compared to the same period last year, total arrests are down from 10.479 to 9,882.
The total decline is 5.7 percent.
5.7 percent less arrests while overall crime is up 5.6 percent. Interesting symmetry. Also, juvenile arrests are down 11.83 percent.
This could mean a number of different things, and none of them seem particularly promising.
The obvious question would be whether the deteriorating relationship between the police union and the police chief has eroded morale, leading officers to work a little less dilligently. Maybe all the overtime is fatiguing the rank and file? Maybe different policing strategies have led to fewer arrests.
The bottom line is that if we believe all the stats provided, more crime is being committed in the city and fewer arrests are being made this year than last. Hard to see the silver lining in that dark conclusion.

It is a very sad day when a Reporter and the facts they present have to be thanked for such a terrible truth being told of the City of San Bernardino, California lacking in an area of protection by Law Enforement that causes any person of decent morals to know that we not only have a serious problem but a DEADLY serious problem!
It is APPARENT to ALL that the POLICE DEPARTMENT **ONE AND ALL** can NOT be TRUSTED to PROCTECT THIS CITY EVER AGAIN! NEVER!!!
This is not just a critical problem but a CITY in CRISIS! We need the NATIONAL GUARD or at least The ENTIRE responsibilities of the POLICE DEPARTMENT to be turned over to the San Bernardino County Sheriff Department IMMEDIATELY!
Mr. Rogers, there are so many people (citizens) in this City living in fear of the Police Department and knowing they can not and do not dare for a second to report what they see the Police doing, saying and not doing, because they are threaten time and again! And, we have NO ONE to Go To, to report this to!
We can't go to the Mayor! Him and his Police Chief are way to close and have the Chief of this Police Department investigate the Police???? He is so distrusted by his own that he couldn't get to first base!
And, by their own Internal Affairs Department.. The Boys in Blue by the own boys in blue.. it isn't going to happen in favor of the Citizens and that's a fact!..
The Police of this City, Just are not trusted.. they have NO Friends in this City because they have made it a point to make enemies with the citizens of this City! If ever they tried or attemped to be friends it has not been for a very, very long time.
As, for the lowly citizens attempting or trying to take these matters up with the Mayor and him - been there done that as well as others and all have had the experience of hearing me say "I don't speak to anyone until they clear through my Chief of Staff the subject matter."
As, for me, I didn't vote for his son, his chief of staff, who I know is all to loose with his lips. He didn't swear or take any oath to protect the Citizens of this City - so he can do as he pleases with the information shared with him. And, I won't sink my ship for him.
Knowing the closeness of the Mayor and the Chief of Police - like it or not - it is dangerous and retalitions have been spoken about more than once by Police Officers should a Citizen report them for not fulfilling their duties in the past..
How, are us, we the Citizens, to have a voice?
Three minutes in front of the City Clerk before she tells you to sit down!
I reported car thieves in the act of stealing a vehicle three blocks away from the Main Police Stations.. it was THREE hours later I received a call back from the Police Department and was asked if the perpetrators were still on the property! All I could do was laugh and hang up on them.
Millions of dollars worth of airconditioning units in this City have been stipped.. and not one single bad guy has been seen caught doing it! And, you say that arrest are down! And, bye the bye I did say MILLION$$$$$$$
Old, Bill, came home, in his mobil wheel chair, to find his home vandelelized and burgularized.. and in tears, he called our Police Department, and was told they were to busy to be bothered with some burgulary and to mail them a letter telling them what was taken!
A very real and true story, right here in San Bernardino, CA - When a Lady reports her home being INVADED by a BURGULAR at 4:00 A.M. in the MORNING and the POLICE DISPATCHER ask her the name of the burgular before they send out a police car????????????
Policeman runs over a beautiful 100 pound Labrador dragging it down the street over a 150 feet. After mutaling the body - never even stops to take what is left of the pup by the feet and at least drag it to the side of the street where no one else would run over the huge carcass again. Instead, turns the Police car around and heads three block away back to the Police station as two witnesses stood their in shock. How the pup got out of a locked fenced yard no one knows to this day.. but I was called and came over and for over 100 feet picked up stewn pieces of the insides of that pup and then picked up the main part of the body and moved it where it could be and receive proper burial.
Speaking in front of the City Council and Rachel Clark and her 3 minute timer isn't going to do it! Besides, who cares, the Police Department? The Mayor? hmm? I'm kinda at a loss on this one.
Talking to the MAYOR.. nut-uh! Danger-all over the place.. same with the POLICE Chief... 6 of one half dozen of the other...
Dare to talk with anyone at the Police Department about the above or many, many more true incidents that infest out City... which also include the Police of the Police Department.. were now talking about retaliation lurking in the shadows somewhere...
This City is in a crisis..
But, Mr. Rogers, you've showed some real reporting.. again, I thank you for having the guts.. to stand up and tell it like it is, again, I thank you, Sir.

Speaking of small crimes, is it not breaking laws and ordinances in place that state that a taxpayer funded vehicle should not engage in the business of campaigning. Would the witness who walked by the Mayor's taxpayer City auotomobile next to his home please give us more details? I heard that the Mayor's Prius auto was full of Milligan signs this last Saturday, 9-29-07. Could the witness provide info about how many signs there were? Were the signs in the back or front seats? Was the Mayor's vehicle occupied or not. What time of the day was this? What color is the vehicle in question in case the classic "it wasn't me" excuse is used. Oh, one more thing, what street was this vehicle parked on?

One really has to wonder how many times Penman and his lapdogs are going to throw the red herring around, it already wreaks of corruption festering in the absence of ethics and morals without another layer added by shameful incidents like Penman getting up to say he doesn't support a recall ~ when there is no recall to support in the first place, and, now this post to make sure we don't experience so much as one day of one month without "Penmanonium".
Just in case anyone misses it, the "post" above is addressed to a mysterious "nobody" who supposedly witnessed something and shared about somewhere besides here ~ there is ZERO mention of this non-incident of Penmanonium posted prior to the time stamp of the post above this one ~

This may not be directly connected to the subject matter of the article, but since all other spaces are filled, here is my take on another type of criminal statistics not kept in the record books.
There are many who were connected to the crooks in City Hall who were found out and sent packing that come out of the woodwork at every opportunity to attempt to exact a perverted vendetta against Penman. Some may be relatives, friends, OLD cronies, or some may be just college or university educated young people who take a semester of school and come out thinking they have all the answers.
Some people are not brave enough to come out of the woodwork and present there views at the Council meetings, they prefer to snipe away from the safe confines of their computer chair and not ever take the opportunity to know the candidates. I saw first hand and heard Milligan at a neighborhood watch forum in which each candidate was given eight minutes to speak. With her voice quivering during her time slot, she could not even complete the eight minute time slot. Can you imagine how she would represent the City in court? This was not a question and answer timeslot, it was all hers to tell us what she knows; well that took about five minutes and then, she sat down. I guess she missed the Morris camp to prop her up and prompt her on how she could be effective as a City Attorney.

I stumbled upon this blog inadvertently as I continue to stay up to date on the happenings in San Bernardino. The City holds a near and dear spot in my heart. But I felt compelled to correct a mis-statement by Mr. Ortiz regarding his representation that the City Attorney represents the City in court.
I was a Deputy City Attorney in San Bernardino from May 1997 to September 1999 when I chose to leave for personal reasons. I researched, authored and obtained the very first two gang injunctions in the Inland Empire. I also researched, authored and obtained the very first prostitution injunction of it's kind in the Country on Baseline. I also closed the drug house known as Norman Manor which was directly across the street from San Bernardino High School. These were all projects I initiated and was solely responsible for. During my time in San Bernardino I had the pleasure to work closely with the police department. The officers I worked with had a true commitment to better the City and worked tirelessly with me on obtaining the various abatement actions. Then Captain Michael Billdt was extremely supportive in offering resources and manpower in an effort to help me. On December 4, 1998 I was awarded the Distinguished Service Medal for the work I did. While Mr. Penman was extremely supportive and allowed me carte blanc to move forward with projects, he did not argue the cases in court. In fact, during my employment there I don't believe he argued any case in court, his staff attorneys did that.
Similarly, the City Attorney for the City I have worked for since 1999 does not go to court. The litigation attorneys are assigned litigation matters and make the requisite court appearances. Therefore, Mr. Ortiz' commentary regarding Ms. Milligan's ability to represent the City in court is without merit.
Finally, I have known Ms. Milligan for 17 years. I have seen her in court numerous times and even argued together companian cases involving our respective police agencies at the Court of Appeal. She is an outstanding litigator and highly thought of in City Attorney circles in Orange County. I also had the pleasure of writing to the California Supreme Court on behalf of the entire League of California Cities asking them to grant a Petition for Review she authored to the Cal Supremes. Her writing and analytical skills were outstanding. I was troubled by all the negative comments being posted regarding her legal abilities and felt compelled to speak from first hand knowledge.
This election shouldn't be a smear campaign but rather a focused effort to address the issues the City faces. When I was there I felt like the City was making some giant strides at innovative problem solving and I hope that can once again occur. I am aware that the City is undergoing rough times. I wish the citizens could experience first hand, as I did, the commitment of the San Bernardino Police Department to make things better. The City of San Bernardino will always have a very special place in my heart and I am proud of and thankful for the work I did there.

A Reporter for the San Bernardino Sun has probably broken the most important story in the past 10 years of and about what is happening in this City!
Both the Mayor and The Chief of Police have bragged in recent times of how crime has been reduced in the past year and a half in this City. And, now we are very much aware that is NOT THE TRUTH!
Crime [violent] serious crime in all areas except for vehicle theft is seriously, back up! And, Going UP and UP!
And, the POLICE DEPARTMENT while collecting MILLIONS of DOLLARS in paychecks have reduced their performace in making arrest by almost 6% in the same exact time..
Meaning every CITIZEN of this CITY OF SAN BERNARDINO, CA is in DIRE DANGER! The City is in CRISIS! While a thousands of known victims (not including the unknown) are suffering.. And, we have people here pushing politics!
What's wrong with this picture?
Get the picture? Read the report again! Our POLICE DEPARTMENT IS FAILING, big TIME!
If you don't care about yourself then think about someone else, for once! The CHILDREN ARE IN DANGER! Can't you see that?
Your family, your property, you, your neighbors, your friends, visitors to this City of San Bernardino, Ca are all in DIRE DANGER!

1. The Penman campaign is the one with the OLD cronies and the perverse vendettas ~ just look at the PUBLISHED FACTS.

3. There’s no reason to monologue at the podium for political diatribes. Remember Jeff Wright? His abuse of the podium is what motivated the current 3-minute constraint.
4. Marianne Milligan has appeared at numerous meetings throughout Southern California for years & years. She has earned the respect and admiration of her peers. She has gone up to the California Superior Court. Her voice is clear, projective and firm.
5. I’d suggest you get your ears checked before suggesting MARIANNE MILLIGAN FOR CITY ATTORNEY get her voice checked. She has never ~ not once ~ spoken with a “quivering voice” in all the times I have been present to witness her speaking before various groups. How about the citizens of the City here in Southern, California where she left before headed towards San Bernardino, Ca a couple of years ago? Her voice cost them THREE QUARTERS OF A MILLIONS DOLLARS .. THAT'S $750,000.00 in a court case SHE CAUSED... How many of those PEERS do you think want here back?
Because of her their CITY ATTORNEY'S OFFICE was demolished.. KAPUT!
Sounds like something the Mayor wants to have happen right here in San Bernardino, Ca.. And, the right party to get the ball rolling...
Means.. FREE RENTS and or spectaular deals for 40-50 hangers over at the AIRPORT.. and high paying Board of Directorships.. And, run away traffic and pollution if no one legally around to protect the citizens of this City of San Bernardino, Ca...

We all know the legal system is costly. Just look at the thousands Jim Penman claimed as in-kind legal service of benefit to his campaign ~ legal services that outpace those of both the candidates successfully defending themselves against these allegations, even when split in half they total more than the legal fees of one candidate ~ the other candidate (not an attorney) did not even have legal representation and was also victorious by any measure. You know, the REAL question would appear to be how the Penman-Wilcox v Milligan & Turner simple case, easily won on most points by a non-attorney with prima facia evidence with the other half professionally defended for well under $10,000.00 could fairly claim almost $20,000.00 in prosecutorial expenses. Honestly, my first impression when learning these figures was, “Oh, no! Not money laundering, too!”
But it doesn’t stop there. How many millions of dollars have been bled from San Bernardino City as a direct result of fiascos in the legal arena? Let’s be fair and only go back to 2000. How many dollars has each candidate cost their municipality? For Jim Penman there are MANY REPORTED. For Marianne Milligan there are NONE REPORTED. The red herring those seeking to distract voters from the truth with is that, through some amazing feat of prestidigitation, the MALE who cost Costa Mesa under $1,000,000.00 is somehow supposed to become converted into the female presence of Marianne Milligan. Had the accused not cried foul, reminding us all of Rodney King getting public funds to fill his crack pipe so he could careen through IE streets doing further damage with his life’s time, there would not have been even that to invent by those desperate to sully her candidacy and hold on to the old guard a few more years. The kind of people who think Rodney King is a hero for getting vast amounts of money are the kinds of people that can convolute the truth and spoon feed it to others as equally small-minded.

I want to respond to Paula Coleman's posting which was carried yesterday under "Crime Stats Tell Puzzling Tale." Unfortunately, it is not possible to post anything else under that article due to the advertisement placement.
Paula was a great Deputy City Attorney and we were sorry we were never able to get her to relocate here from Orange County. She went back to work there in 1999, after two years in our office.
Paula is correct that I did assign her to gang and prostitution injunctions.
However, this office based its first injunction against gang-related activity, but against a family,not against a specific gang, in the case of People v. Ortiz which was filed in 1995, two years before Paula joined us.
We extrapolated from the Street Terrorism Act, which was re-enacted in 1993, to bring that case which involved gang members shooting up a house across the street from San Bernardino High School. The large family, which seemed to function as a gang in that house, would shoot back at the gang members attacking their residence. The bullets were flying onto the campus at SBHS. The School District Police asked for our help and we successfully prosecuted that injunction which ended the problem.
We had to suspend our anti-gang injunctions when the case of People v. Acuna went up on appeal as a result of a gang injunction brought by the City of San Jose.
On January 30,1997, when the courts ruled in favor of the City of San Jose in the Acuna case, I immediately directed attorneys in our office to begin work with the police department to identify and gather evidence on San Bernardino gangs that we could target with injunctions.
When Ms. Coleman joined our office later in 1997, she was assigned the task of renewing our "nuisance abatement" actions against gangs.
Later, after reading of a successful application of nuisance abatement laws to prostitutes in San Diego, I directed Ms. Coleman to work up and file an injunction against prostitutes working on Baseline.
Ms. Coleman always expressed pleasure at the fact that our office was so proactive, unlike her previous experience in an appointed City Attorney's office in Orange County.
In fact,five months after leaving our office, Ms. Coleman, who had returned to work in an Orange County City Attorney's office, contacted me and expressed her disappointment at not being able to do there the proactive anti-gang, anti-prostitute legal actions that she had worked on here in San Bernardino.
Ms. Coleman, as a result of working on some of the anti-gang injunctions pioneered in this city by the City Attorney's Office, became an expert in such injunctions.
She did a great job and I credit her hard work as part of the reason we have been so successful in that area of municipal law.
It was great to see her entry on the Sun's blog.

Please note the time of Jim Penman’s post ~ at 8:42 this morning he was clicking the “Post” button. Visitors to SBNow site have often made remark of employment. Is blogging really what you want your tax money going to? And, wasn’t there a post earlier about City materials and services and the FPPC?
Which was it? Was Jim Penman on personal time, equipment & services this morning, campaigning instead of working, or, was he blogging with municipal resources while on the taxpayer payroll? Or, does he bring his personal laptop to City Hall and blog while “there but not there”? This is a question deserving of an answer from Jim Penman himself.
As for the “demolition” of Costa Mesa City Attorney Offices. I think you mean disbanded. The physical structure is still there and there were no explosive devices involved. The City of Costa Mesa still has legal representation without the consistent overhead of Office of City Attorney. The City of Costa Mesa legal work is farmed out to attorneys opined to be the best suited for each sphere of importance, just as they are farmed out in San Bernardino though we have an office of city attorney here.
This was a hot topic not too long ago, when San Bernardino was mulling the disbandment of Office of City Attorney and adoption of the Costa Mesa model, also popular in many other municipalities. Had we then determined to act as Costa Mesa has and gone for the independent counsel model, would you blame that decision on the most recent case whereby a monetary award was granted and cast aspersions upon Jim Penman?
If you’re going to play, play fair. What’s good for that goose is good for that gander, too!
As for the airport: Please expand your horizons ~ you seem to be viewing the world from such a narrow and close perspective. The fact is there is tremendous (Some have ventured to say too much) oversight and regulation regarding American airports. There are MANY hoops to be passed through and MANY regulations to be consistently respected for an airport to exist and remain a presence in San Bernardino and anywhere else in the USA. We are looking beyond the city limits here to our FAA and other nationwide federal entities.
In addition, there are many private, public, non-profit and other aggregations addressing the issues of sound and other pollutants. There are 800 numbers & websites in place for voicing concerns to the proper federal and other authorities. We are not living in isolation, or a vacuum.
The mayor’s endorsement is but one of VERY MANY MARIANNE MILLIGAN FOR CITY ATTORNEY has the good fortune of counting as evidence of her wide-spread support. This is just as Jim Penman has a few who have not stopped endorsing him, as the SBPOA ( SBPD ) has dropped endorsing him ~ they aren’t “the boss of him” anymore than the mayor is “the boss of her”, in the juvenile parlance that seems to work here.
The FACT of the matter is I am about the only person who attentively offers quotes and links for verification of my statements in my comments. When I wrote MARIANNE MILLIGAN FOR CITY ATTORNEY continues to be respected and admired by her peers, I proved it with the link already copied above, with copied text, for your convenience. When I wrote that Joe appears to be a blatant liar in regard to MARIANNE MILLIGAN FOR CITY ATTORNEY “quivering” in a public forum, I prefaced it with my own personal observations of her speaking skills. She is no shrinking violet ~ she is a confident, well-spoken professional with SUPERIOR communication skills.
Are you saying Penman is less than top-notch because he has run for office here so many years? You can’t have it both ways, with Penman being fine in your eyes for being here and MARIANNE MILLIGAN FOR CITY ATTORNEY being less than the same for also being here.

Due to destroying a major District Attorney's Office if not run out of the other Southern California town then Millegan (SHE) ran out of town - because she destroyed jobs of her's and those livelyhoods of her peers with her VOICE - And, Mariane Milligan - is now seeking that same position her in San Bernardino, Ca ..while.. like you ..sucking up to a Mayor.. who continues to denies that.. VIOLENT CRIMES are UP in this CITY as proven in the report in the San Bernardino Sun Newspaper by Mr. Rogers!
Now, either you're lieing about Milligan being a top notch professional as is the Mayor..
And, the Mayor is Lieing about MAJOR Violent Crimes NOT being up and Milligan being a Top Notch professional..
or Mr. Rogers and the Sun are lieing about Violent Crimes being up in this City of San Bernardino, Ca. And, the Police Department's arrest records for these major crimes down almost 6%.
I'll go with Mr. Rogers and the San Bernardino Sun long before I would believe you and Pat Morris, thea Mayor.
There are children of all ages dieing! There are thousand upong thousands of victims in this City suferring from disasters being brought upon them because a POLICE DEPARTMENT is FAILING THE CITY!
Is there one single person that cares other than this lady that wants to stuff her cheeks full of bell peppers?

THE BOTTOM LINE IS THIS CITY WAS IN MUCH BETTER SHAPE IN 1987 BEFORE PENMAN TOOK OVER CITY HALL WITH HIS ANTICS. LET'S END HIS REIGN (OR IS IT RAIN)?

Before anything, let me rise at your side toward Teacher and declare that your grammar, punctuation, syntax and even, in some instances, your spelling are improving. Your messages are understood. You are communicating effectively. Please, continue sharing with us all the mindset of the Penman supporter. Your homespun posts are a little rough around the edges, but all of us seem to be typing off the cuff, so don’t let one teacher’s spontaneous commentary slow your pace.

The legal work of Costa Mesa is still completed competently, the system by which it is assigned is all that changed. They adopted the same system offered to San Bernardino a short time ago. It is the same system used by many municipalities. The majority of these are unfamiliar with either Jim Penman or Marianne Milligan. You seem to equate their transference from the city attorney-based model as something akin to the results of a disaster. What was the Jim Penman disaster predicating the lobby for our adoption of the same method here? I say there was none here, as there was none in Costa Mesa.
Think about it, David. If financial fiascos were the true impetus for a change to the Costa Mesa model, San Bernardino would have had it in place before San Bernardino City Attorney Jim Penman, as ultimate legal authority in San Bernardino, had cost us the first of many millions in avoidable payouts. But, no. We retain the city attorney model despite losing millions of dollars in well-documented cases, and untold more through convoluted means best left to the forensic accountants for sorting out.
It isn’t beneficial for The City to close ranks and only employee the good ol’ boys, it isn’t legal either. We cast a wide net, sometimes nationwide, as when we were searching for the best candidate to head our EDA. That we have the very best our nationwide searches have to offer is a testament to the lengths San Bernardino is willing to go to hire the best and the brightest applicants possible. That some of them must leave us, to move on up the ladder, as our recent loss to Sacramento, at the behest of none other than the governor himself, is further credit toward the caliber of San Bernardino municipal employees we are most fortunate to count as our own.
As for the statistics: To remind you, both the statement that crime is up and the statement that crime is down are true. Remember, what is important is the time period you reference in your claim. Crime IS DOWN, since the time of the other SBPD employee vendor tee shirts ~ AND in the most recent FBI UCR stats released; crime is UP since this time, last year. Have patience, subsequent FBI UCR stats will accurately reflect this.
Penultimately, please contemplate the benefits of treating others as you would have them treat you. You may find fault in the mayor, me and any number of people, but remember, please, as Jesus Christ The Son of God asked, “Who among you can cast the first stone”. The way you disparage others is unflattering. You can do better. I believe in the good in you. Please, try.
Lastly, as a raw vegan ( who went wild and enjoyed the WOK spicy green beans at A Taste of Thai during a dinner meeting tonight, so preface that with “ever transitioning”), I encourage you to experience a return to pure, whole fresh foods. The health benefits of bell peppers and other fresh, wholesome foods are no joke ~ neither are the detriments of the SAD diet ~ that being the Standard American Diet.
