Someone will get a subpoena

Tuesday evening, the council rejected First Ward Councilwoman Esther Estrada's attempt to subpoena Police Chief Michael Billdt, former Operation Phoenix Director Glenn Baude, Parks and Recreation director Kevin Hawkins and recreation officials Curtis Brown and Glenda Martin-Robinson.

But the council did subpoena an as-yet unnamed individual during closed session.

"It's related to the incident at the Hernandez Center," City Attorney James F. Penman said Wednesday. "We're not giving the name of the person being subpoenaed."

"We don't want the person to know they're about to served," Penman added. "It's not an employee of the city."

The Hernandez Center, near downtown, was the place where former Phoenix center manager Mike Miller, reportedly snapped nude photos of a female. Miller is awaiting trial on suspicion of child molestation. Police and prosecutors have determined that all participants in the photo incident were adults and no crime was committed.

There has been some controversy as to whether police waited too long to interview a now-fired recreation supervisor who told police about five weeks after Miller's July 3 arrest that all parties were over 18.

Assistant District Attorney Dennis Christy has sought to defuse those concerns. He has said prosecutors knew of the photos at an early point of the Miller investigation and did not consider the pictures to be evidence of criminal activity.
