DA's spokeswoman confirms Penman interviews

| | Comments (14) |

San Bernardino County District Attorney's Office spokeswoman Susan Mickey confirmed that San Bernardino City Attorney James F. Penman has spoken with top prosecturors

"The only thing I can confirm is he spoke with (District Attorney) Mike (Ramos) on Sept. 22 and he spoke with Mr. (assistant district attorney Jim) Hackleman on Oct. 7," Mickey said.

Penman has said he provided statements to both Ramos and Hackleman regarding the city memo that was either lost or stolen from a City Hall bathroom.

Police have said they are investigating the memo's disappearance as a theft, whereas Penman has said no theft took place and that someone lawfully delivered the memo to his office.

The memo, of course, is the now infamous document in which Police Chief Keith Kilmer summarized a Police Department investigation into the presence of a registered sex offender who performed work at the church that hosts the city's flagship Operation Phoenix youth center.

The youth center is the very center once managed by Mike Miller, who was arrested on suspicion of child molestation last year.

Well it appears that the story here is…there is NO story. Mr. Penman stated he has and is working with the D/A as requested, when requested as the D/A does their investigation. What the SB Police Chief is doing is nothing more than creating a political smoke screen for his boss (Mayor Morris) to make it appear that Mr. Penman is or was being uncooperative thus obstructing the police investigation. Now that the truth is out, (that Penman has been cooperating with the unbiased D/A investigators) it will be interesting to see what else the Mayor and his puppets can come up with to farther slander Mr. Penman as we get closer to election day.

LOL!
Penman can't remember to go to interviews with any of the local papers for his campaign, but, after sitting on the memo for a while and thinking up a potentially plausible excuse, then goes and interviews with the D.A.
LOL!
I can see this having gone something like this,

PENMAN:
"Employee of City Hall, give me the memo and I'll get a buddy of mine to get you out of here and set you up elsewhere/I’ll use my sway to get you in as my replacement as city attorney"

EMPLOYEE OF CITY HALL: "Here ya go, Buddy!"

PENMAN:
"OK! We're going to say it was "forgotten" it in the ladies' room & a mystery person whose identity we must conceal to protect her from Others lawfully handed it over to me. Wait. I've got someone else I can pull in on this, to add a layer between us for my own good."

STAFF: "Yes, Boss?"

PENMAN: "City Hall Employee here is going to hand you a memo stamped "Confidential". I want you to then, legally, hand that memo to me".

STAFF: "Yes, Boss"

Note: Staff speech is limited to "Yes, Boss" in Office of City Attorney

PENMAN: "City Hall Employee, go back about your business. Stand firm. It will be worth it for you when this all blows over. I take care of my friends and never forget a favor".

CITY HALL EMPLOYEE: "Yes, Boss"

PENMAN: "Now, leave my inner sanctum and act none the wiser when others are around".

CITY HALL EMPLOYEE: "Why do I feel like a Judas?"

PENMAN: "Judas got a bad rap, too. Just like the one I'm about to sling across San Bernardino in hopes of finally getting to sit up on the dais with the big boys & girls. Now, be gone I say!"

Here's my open letter to City Hall Employee,

Dear Sir,

Most people in San Bernardino know you are male, and that the whole "women's lavatory" was another on Penman's red herrings to attempt throwing us off your tracks. Again, it didn't work, did it?
Even so, most people in San Bernardino are forgiving Christians and will appreciate you coming forward to repent your moment of weakness and set matter straight before this goes any farther.
Please, look inside yourself. You know you feel dirty and ashamed for the deception against our city.
Only one thing will take that dishonor away: Doing The Right Thing
Please, do the right thing and set things straight.
Penman will not be re-elected as our city's attorney ever again.
A recall effort is already forming and poised to launch once the mayoral race is over - so as not to be construed as a distraction to the campaigns.
You may be our next city attorney, a city hero, lauded for clearing the largest block of corruption from City Hall, if only you will take a deep cleansing breath and blow the cover off Memogate.

Wishing you clarity of mind as you consider this offer,

Most People in San Bernardino

Penman didn't forget to do anything. He chose not to be interviewed by a Morris owned paper. Why should he? He should be out walking precincts. Or better yet, doing his job at city hall. I am assuming Morris used city time to do that interview also. And Just Another Alias, your hatred is so self-consuming. You ought to go get some counseling. You are angry because Morris' attempt at covering up another pedophile on Op Ph property failed. That is the real crime here.

Dear Just Another Alias,
I wish you would admit that you don't know what you are talking about.
You should apologize for what you have written.
Lies won't help San Bernardino.

Just Another Alias said:

@Cry Babies - No hating going on over here, and that's for sure! It's a GREAT DAY in San Bernardino EVERY DAY these past 4 years with thousands of new jobs already here and tens of thousands of green jobs on the way - over 10,000 more than Norton when Norton was at its peak, as a matter of fact!
LESS low-income housing a reality with Arden-Guthrie now a construction site for commercial retail (the paperwork signed off on as legal by Penman himself, though he insists on screaching it is MORE low-income housing - Since when is a Home Depot and retail shops "low income housing"? LOL!
What a sad sack Penman's showing himself to be.
Then again, being shown up in 4 short years by a fellow attorney (and former judge of national acclaim) must hurt terribly after Penman's over 20 years of NOTHING but FAILURES (and all at taxpayer expense, of course)
It's not "hate" and it's not "lies", it's JOY for a NEW BEGINNING in SB, well on the way over these past 4 years with Mayor Morris as our leader - and with even MORE SUCCESSES to come in these next four years, when we, again, elect Mayor Pat Morris as our mayor.

@ Saddened -
I'll apologize when the person who supplied Penman the "Memogate memo" comes forward and declares in public that things are not as they appear.

Dear Just Another Alias,
I think Ms. Roth has already explained the situation perfectly:

Your comment "Note: Staff speech is limited to "Yes, Boss" in Office of City Attorney" is obviously unfounded and unneccesarily offensive. You would apologize if you had integrity.

Just Another Alias said:

It's because I've got integrity that I don't turn a blind eye to Penman's antics.
Like the vast majority of San Bernardino voters, I speak out with my vote.
This blog is an opportunity for us all to speak out in another format besides the ballot.
Goodness knows we certainly can't get away with speaking live on air for 20 minutes non-stop, like Penman did at the last council meeting, as he put it so emphatically, "as a private citizen".
I stand by what I've written (above) and earnestly look forward to be proven wrong (but that it were possible in this case).
The letter submitted by the beta hound in the Office of City Attorney Penman Pack is nothing more than #2 position doing what it takes to safeguard the position - so that all it took to get there won't be lost in a flash - as has happened to more than one in that office before her (as she all-too-well is aware).
Let's not divert the focus from the sleazy tactics of Penman, finally in the end game of his 4-year campaign to recoup his tremendous loss at the polls last time (remember? click here: http://www.co.san-bernardino.ca.us/ROV/past_elections/archive/020706/default.asp?ElectionID=95&ElecDateID=020706

For his devastating loss at the polls the last time he ran for mayor (the last time it was up for election), these are those results (for those not wanting to click on links here),

Alias,
My point is this: you are guilty of libel with regard to Penman's Staff. Your inability to recognize this is indicative of your inability to delineate between fact and fiction. You suppose facts and defame innocent poeple with your words. This is why I say you lack integrity. My statement is not a defamation. I gave you the opportunity to correct yourself when I pointed out your mistake. You chose to stand your ground.
The fact that Penman is an elected official changes the criteria of libel against him. Please notice that I did not attack you for your comments about him. Freedom of speech comes with resposibilities and restrictions...and defamation is a tort.
If you truly have the integrity you claim, an apology for slighting his staff would be commendable.
I assume you are a good person, who has made a mistake.
As for Arden-Guthrie, you are right, that will be commercial buildings...the area where the low income housing will be put is a block away (as highlighted on Morris' mailer).
All I am saying to you is: I am not concerned with what you say about Penman, but your denegration of Penman's staff is offbase. It is unfair and you are wrong for making those comments and they deserve an apology. The integrity you claim demands it. I am not asking for an apology for your comments about Penman (he signed up for battle when he put his name on a ballot).
Listen, I understand your mistake, but my understanding doesn't make it NOT a mistake.
If you can't understand what I am trying to say to you, then I am done and will move on.
I call San Bernardino home and I hope this city improves regardless of who wins.
I wish you the best and hope you have compassion in your heart for the innocent people who are hurt by your words.

You know what?
I can "hear" the sincerity in the tone of your post and I'm appreciative of it.
San Bernardino seems a place where dialogue like this is evermore possible (with a stunning exception in Penman).
I am _happy_ to have this exchange of words with you. It's been a long time in the coming! :-)
THIS is what I'm comfortable saying,
My post(s) above were in no way, fashion, or form intended to disparge the hardworking, long-suffering employees in Office of City Attorney. To the contrary, they were intended as a means to highlight how obtuse and dictatorial Penman is with Staff (and others). As we've seen with increasing frequency and intensity, Penman's stance is, "My way or the highway".
I've known members of Penman's staff for as long as Penman's been in office. On the whole I like them (investigators there are in one column, the clerical and support staff another, the former below the latter by far). Some I am especially fond of and have additional compassion toward for the conditions endured to bring home a paycheck. It's above and beyond.
We, as members of the community suffer, but the people enclosed behind those glass walls and doors on 6th floor's city attorney office suffer far more than us, day in and day out.
Should the recall of Penman take place as more and more people are saying, I will rejoice with the employees in Penman's then former office for finally being free and able to work in a less stressful and more humane environment.
Again, there is not even a modicum of disrespect or intent to disparage directed at ANY of the many employees in Penman's office. Who among us hasn't had to clean a toilet, or mop a floor, or be out of town on business during an important family function, in the interest of remaining gainfully employed?
Obviously, I am not a skilled writer; my message wasn't clearly conveyed in my post(s) above.
If there was any heartache, or other untoward sentiment associated, I am truly sorry. The people in Penman's office suffer far too much already without ANYONE causing them any additional negativity in their lives in ANY way whatsoever.
In saying these words I am 100% sincere. :-)

In closing, I am one of the majority voting for Mayor Morris to continue the good he's proven successful at bringing across our city. While not "mayor material" myself, I, like the mayor, do my very best. I feel a nurturing, supportive environment for each of us to become the best we are capable of under his administration. In prior administrations my perception was more one of "you are beneath us, be gone", not unlike Penman's attitude when not trying to sway someone. I like the sense of inclusion at city hall and the benefits to our city Mayor Morris' collaborative efforts have attained (such as getting the other cities to agree to allow funding to move our way so the 215 project could continue and not stall.
Who knows? Maybe we'll meet someday. If so, I'll have a big smile and kind words for you, for having been a part of what's right with San Bernardino in this blog. :-)
Peace.

Yes, Jimmy, I am sure you will meet the blogger above...in court. You are a pinhead and not very transparent. The inclusion in city hall is non-existent unless you have been hand picked by Daddy to play in his sand box. He has rebuffed many people including developers who walked away because it wasn't Daddy's idea. That is not inclusive. They took jobs with them. But I am happy to hear of the warm and fuzzies you are feeling being there. Hope your resume is warmed up.

Alias,
I commend you for having the maturity to apologize. I assume those in Penman's office will appreciate it.

Just Another Alias said:

Not So,

You're hilarious!
I'm "the blogger above" your entry and have no intention of taking any one to court.

Your entry jumps all over the place, the dots don't connect.

For the edification of any future readers of this page,

The many community based entities now thriving across our city are evidence of the inclusive attitude at city hall during the Morris administration. Their familiarity with the nuances of their targeted demographics attributes to their award winning successes. To our city's detriment, these entities were excluded in years past when infighting was the order of the day and problems grew unattended, like neglected children in a dysfunctional household the city's concerns floundered and worse so Penman could infight with those in power. This administration, despite what have arguably been the most dedicated efforts of Penman to deter progress at any cost, has been successful on every plane. The public sees this and is appreciative with the polls showing, as I published earlier on this page, a 2+: 1 favor for the re-election of Mayor Morris as opposed to Penman.
San Bernardino provides thousands of new jobs that didn't exist here before this administration and is in inclusive negotiations for yet more, including a green project on a global level at the airport providing many thousands more jobs that Norton at its best.
Your voice is one of many across San Bernardino and has value the same as any other. Cummulatively, the voices of San Bernardino clammor overwhelmingly for the re-election of Mayor Morris.
Reasons for this impressive citywide support of our mayor are listed with links to official documents for verification, extensive lists of endorsers and supporters and more at www.MayorMorris.com
There is also a www.electpenman.com site. That's the one with the "Quotes" page provoking former mayor Valles to come out of retirement and issue a statement to the press last week stating for the record, "I am not endorsing Penman" in response to Penman publishing her quote on the page with 2 others as an implied "edorsement".
Despite Mrs. Valles' published clarification as to the truth about her own stance in these elections, Penman continues to leave Mrs. Valles antiquated obsolete quote as-is on his site. It is a quote after all. What the quotes are not are endorsements. Penman is sly and used "Quotes" as the title for the page betting on Jane & Joe Voter assuming the "quotes" were a) recent, b) addressing the campaign, and c) endorsements. The 3 quotes are none of those.
Our community owes yet more thanks to Mrs. Valles for stepping forward to clarify this most recent attempted and continuing Penman deception of the voters.
Mayor Morris has numerous endorsements, supporters and successes all readily available for review on the website provided earlier in this entry.
Penman's website dedicated a whole webpage to 3 short quotes instead of publishing endorsers, supporters, and successes. Why? It seems the best Penman could come up with was 3 quotes - one already rebuked by the author (Mrs. Valles) in last week's paper.

Chris Jones is the "slick" political consultant used by Joe Arnett and Jason Desjardins. He is used by Jim Penman as well.
This is how he works. Read the whole article at the link below. These are just some of the interesting facts:

"Voters are left wondering how to assess slick appeals written by campaigns free to bend the truth. Mailers sent by clients of Jones and Lewis illustrate that dilemma."

"The sleaziness of some mailers caused the county GOP some years ago to create a procedure to investigate complaints in Republican primaries. It led two weeks ago to the censure of Jones and the Assembly candidate who hired him, John C. Kellogg."

"A lot of sleazy things are done by campaigns," said Roy Behr, a Democratic consultant based in Los Angeles. "Fortunately, most voters are able to see through those kind of tactics, and most of the time, they don't succeed."

Changing my Vote said:

I voted for Mr Penman four years ago. I have been watching the city council meetings for several months and I am changing my vote this year in favor of Mayor Morris. Mr Penman seems hostile, obstructive and bent on furthering his own agenda. He needs to stick to his job of providing legal advice to the common council. Mayor Morris was able to be in control of a very hostile meeting today, and if he is able to do that he has my vote! Also I really like the new city manager's style, I think he will be a change agent for our city.
