San Bernardino mayoral candidates meet again

SAN BERNARDINO -- The city's three mayoral candidates finished Wednesday's political double header with a debate at First Congregational United Church for Christ.

The forum, hosted by Inland Congregations United for Change, offered another chance for office seekers to review the events of the past 3 and one half years and prospects for the next four.

The evening debate did not differ greatly from the luncheon forum that local Rotarians and Kiwanians hosted earlier in the day.

Incumbent Mayor Pat Morris, City Attorney James F. Penman and contractor Rick Avila took part in both events.

Wednesday night's questions reflected San Bernardino residents' concerns with perennial issues like crime and graffiti and hopes that budget cuts to vital but comparatively low profile services like parks and libraries can be reversed.

Morris again pressed his case that the time since he was sworn into office in March of 2006 has been a time of great progress for San Bernardino.

Murders have trended downward during the Morris years. Through August, San Bernardino has experienced 23 criminal homicides, compared with 26 during the same period last year. During the first nine months of 2006, the city suffered through 33 murders.

Overall, reports of serious crime in San Bernardino have come in at numbers similar to last year. Serious crimes have dropped by nearly 2 percent through September, with violent offenses slightly up and property crimes slightly down.

In the first debate, Penman took note of Police Department statistics showing that some crimes, such as robberies involving guns, have climbed by more than 20 percent.

Morris responded in the night debate, accusing his opponent of ignoring the big picture.

"In Mr. Penman's lawyer world, that's what we call cherry-picking, creative lawyering," Morris said.

Penman largely kept to the same message in both sessions. Although he showed a greater interest in restoring funds to parks and libraries during the second debate, he contended that the city has lost focus on the traditional duties of local government.

"Rehabilitating criminals is not something arts and culture will have to do to compete with for money," Penman said in response to a question on how City Hall could support the arts over the next four years.

Penman did not cite a specific dollar figure to say how much the city has spent on parolee programs, and Morris was more than a little ticked off by his opponent's assertion.

"We have not spent one damn dime to rehabilitate parolees," Morris retorted.

Penman has repeatedly claimed that a federally-funded redevelopment project slated for eastern San Bernardino will draw felons to rehabilitated apartments.

Morris says these claims are baseless and that the nonprofit hired to eventually manage those apartments will be able to block troublemakers from the rental units. Federal law mandates the 100 apartments that are planned to be rehabilitee by leased to low-income tenants.

The Morris Administration has also attempted to work with state prisons officials and others, including Cal State San Bernardino academics, on proposals for programs intended to help returning parolees stay clean after prison.

Morris has more than once voiced his frustration that the state's recurring budget crises have so far presented these proposals from being enacted.

Avila, who unlike his opponents does not have an office at City Hall, called himself "an average next door citizen who knows a lot about San Bernardino politics."

If elected, Avila said, he would immediately seek to hire additional city employees to work on refuse operations and clean up areas near freeway off-ramps.

He also said the city has had enough of consultants, and can use the money that would go to finance costly studies could be spent on city operations.

"As mayor, I will do the studies for free. What's to study?," Avila asked.

Morris did recommend that City Hall engage in study to develop a strategic plan to upgrade Library Department operations.

Penman contended that city officials could redirect dollars to libraries and parks by cutting from the top, repeating his contention that the decision to create a highly-paid job for a communications manager is unnecessary.

The city has yet to fill that position, which is not slated to be paid for through the general fund. Council members who voted to create that position say its a needed to help City Hall advertise San Bernardino to businesses.

Mr. Penman has a better idea--make San Bernardino UNATTRACTIVE for parolees by busting their chops! That's the kind of sensible leadership that Mayor Guliani used to successfully clean up New York City.

I was interested in getting more information on Arden Guthrie to decide who was telling the truth Mayor Morris or Councilperson Wendy McCammack. I went out to the EDA web site and read up on what has actually been approved for the Arden Guthrie site and found that what Mayor Morris has stated is true. The Arden Guthrie site is being prepped for commercial development only, and the sunrise area is where hundreds of blighted homes are being demolished and only 100 homes rehabbed. There are no plans to build any low income houses as McCammack stated at last nights’ meeting. I wondered why McCammack would try and deceive the public so close to election time. She said she wanted to “inform” the public. The real answer is fairly transparent, that is, to try and sway votes for City Attorney Penman’s’ bid for Mayor. She succeeded in my case as I will be voting for Mayor Morris, four years ago I voted for Mr. Penman. Her behavior at last nights’ city council meeting was reckless, rude and should not be tolerated. I think the general public should have joined the four council members who made a point not to tolerate this behavior.
Over the years I have learned that in politics all you have to do is follow the money trail and I was shocked at what I found when I followed the Arden Guthrie money trail. I went back a few years searched the San Bernardino County Inactive Property Information Management System. I found the records of when the city offered deals on Arden Guthrie four-plex-units to “first time home buyers”. There were certain rules put in place by the city, for example you had to live in the unit for at least one year. I compared names of people that took advantage of this one time deal and found a recurring name, Jerry Martin. Jerry Martin and his wife are heading the Committee to elect McCammacks' hand selected candidate, Jason Desjardins. I bet she won’t “inform” the public about this historic chain of events. I find it interesting fact about your mans', (Desjardins) campaign supporter (Jerry Martin), has profited off of Arden Gutherie when it was supposed to have profited first time home buyers. I find it interesting that Jerry Martin and his wife are actively campaigning for Penman and they don't even live in the city. Now, both Penman and McCammack are still trying to profit off of Arden Guthery by giving false statements. I say Recall Penman, and McCmmack. Put an end to hired guns like the Martins and Chris Jones from interfering in local politics.

ORDER NO. AC 08-028

WHEREAS, pursuant to San Bernardino Municipal Code (SBMC) §6.09.030 and §6.09.060, the Animal Control Division filed a petition with the Hearing Officer of the City of San Bernardino; and
WHEREAS, pursuant to San Bernardino Municipal Code §6.09.030, the Animal Control Division has served a Notice of Hearing before the Hearing Officer of the City of San Bernardino, relating to the administrative petition, a copy of which is on file in these proceedings; and
WHEREAS, a hearing was held to receive and consider all relevant evidence, objections or protests on October 16, 2008, and;
WHEREAS, Jerry Martin and Sonia Martin, the dogs' owners; Bill Nord; Robert Drage and Mary Drage; Jose Barrera; Frank Hrovat; Lewis Wilson; Bruce Lawson, and Kim Ditton appeared and spoke at the hearing.

NOW THEREFORE, IT IS ORDERED BY THE HEARING OFFICER OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Hearing Officer finds and declares based upon the evidence submitted, that the dogs "Hanzel", a black and brown neutered German Shepherd, and "Kye" a red neutered Golden Retriever constitute a public safety threat and are deemed "Potentially Dangerous".

SECTION 2. The Hearing Officer finds and declares that Hanzel and Kys's owners, Jerry and Sonia Martin must adhere to the provisions of SBMC §6.09.080, (including a $100.00 per dog potentially dangerous dog fee), SBMC §6.09.090, SBMC §6.09.100, SBMC §6.09.110, and SBMC §6.09.120.

SECTION 3. POTENTIALLY DANGEROUS DOG REQUIREMENTS. The owner and caretakers must abide by the following requirements.

1. If Jerry and Sonia Martin do not comply with these PONTENTIALLY DANGEROUS DOG REQUIREMENTS within 10 days from the date this Hearing Order is mailed, the dogs Hanzel and Kye will be impounded, pending a Vicious Dog hearing.
2. Within 10 days from the date of this order, both dogs must be micro-chipped at the owner’s expense. Both dogs must have a valid and current license from the City of San Bernardino at all times.
3. Jerry and Sonia Martin must post on their property in plain view from the street a warning sign with letters at least 1-inch tall stating, “Beware of Potentially Dangerous Dog.”
4. At all times when the dogs are off the owners’ or caretaker’s premises they must be restrained by a substantial leash not longer than 4-feet in length that the dogs cannot break and they must be under the direct physical control of a responsible adult who is physically capable of controlling the dogs with the leash.
5. When either or both of the dogs are off the owner’s or caretaker’s premises the owner or caretaker must securely place on the dog a muzzle that will prevent the dog from biting people but will not cause injury to the dog nor interfere with the dog’s vision, respiration, or ability to drink.
6. All exit gates from the yard where the dogs are harbored must be securely padlocked at all times to prevent any trespassers from entering the property. Padlocks may be opened for the owner or caretaker to pass through the gate and must then be locked immediately after the owner or caretaker passes through.
7. When the owner or caretaker is not in the yard with the animals, the dogs must be kept inside an enclosure from which the dogs cannot escape and into which children cannot trespass. The enclosure or kennel must be constructed of heavy-duty 9-gauge chain link materials with sides at least six feet in height and with a padlocked heavy-duty 9-guage or thicker chain link gate. The floor of the kennel must be a cement slab at least 150 square-feet in area with a solid cover/roof that is securely attached and extends over the entire top of the kennel. The kennel

must be cleaned in accord with the requirements of the San Bernardino
Municipal Code. The kennel must be approved by the City of San Bernardino Animal Control Department. Animal Control shall have the right to inspect the property and dog enclosure for as long as the dogs remain in Jerry or Sonia Martin’s possession, subject to Constitutional requirements.
8. Jerry and Sonia Martin must notify the Animal Control Department if either or both of the dogs die, are sold, transferred, or permanently removed from the City of San Bernardino.
9. These POTENTIALLY DANGEROUS DOG REQUIREMENTS shall apply to any successor owner of the POTENTIALLY DANGEROUS DOGS Hanzel and Kye.
10. The owners and keepers of the dogs Hanzel and Kye must comply with all local and state humane laws. If the owner or keeper violates humane laws or this order, the dogs may be seized and impounded pending a hearing. If found to be in violation of this Hearing Order or humane laws, the owner will be liable for costs and expenses of impounding the dogs. Any violation of this Hearing Order is punishable as a misdemeanor. Any report of aggression displayed by the dogs shall be grounds for seizure pending further hearings.

SECTION 4. Any person aggrieved by this order may appeal to the Animal Control Commission for the City of San Bernardino by filling a written statement with the City Clerk. The statement must include the order number appealed, the specific grounds of your appeal, and the relief or action sought. The written appeal must be received within ten (10) days from the date this order is mailed.

Mr. Jones, do you have any idea of the serious credibility issues that are occurring to Jason Desjardin's campaign since the Martins campaigning for him? The Arden Guthrey mess is the tip of the iceberg. If you don't believe those of us on this blog - and it is more than one or two people - then ask your other candidate Jim Penman or Wendy McCammack. Besides being 5150 they have serious issues following them. They accused Penman of wrong doing earlier this year publicly yet they are working on his and Desjardins campaigns?

Neighbors' dispute over dogs leads to accusations against San Bernardino city attorney

Ordinarily, it would be just another neighborhood squabble.
But in this San Bernardino scrap over allegedly dangerous dogs, the pet owners accuse elected City Attorney Jim Penman of intervening on behalf of their accuser, a political supporter.
"You'd think the city attorney would know to stay out of this," dog owner Jerry Martin said.

Penman denied intervening in political supporter Kim Ditton's complaint against neighbors Jerry and Sonia Martin and their dogs, Hansel and Kye.
Ditton did not respond Friday to requests for an interview.
The dispute dates to Aug. 10, 2008. Sonia Martin said the dogs escaped for a few minutes from the back yard of the Martins' West 18th Street home, and Ditton complained to Animal Control.
According to the officer's report, Ditton accused Hansel and Kye of attacking another dog.

The officer wrote that he didn't believe the two dogs were aggressive toward people.
He cited the Martins for allowing the dogs to run loose and not licensing them.
Ditton and the Martins have clashed repeatedly since November 2006, accusing each other of harassment, court records show.
This time, Ditton pursued her complaint. On Oct. 27, a hearing officer ruled that Hansel and Kye are "potentially dangerous."

That means the Martins must post a warning sign, build a secure kennel and muzzle the dogs when they go out.
Deputy City Attorney Richard Luczak said witnesses testified the dogs chased them.
The Martins say they saw Penman conversing with Ditton and the hearing officer before the October ruling and accused him of abusing his authority. Penman denied influencing the case.
When Ditton missed a February appeal hearing, Penman's top aide persuaded animal control commissioners to grant a continuance. Penman assigned his top deputy, Luczak, and two investigators to a March 11 hearing.
"That's an awful lot of staff time," Jerry Martin said. "What made this so important?"
Luczak said the continuance and staffing levels were routine. Penman said he dispatched investigators when the hearing turned rowdy.
The Martins say they're waiting for the commission's final order before deciding on the next step in what they vow will be a determined legal battle.

Alledgedly Penman and Martin have quite a history together. In fact Penman and Martin have both served at the Home of Neighborly Service on the westside as board members.

She succeeded in my case as I will be voting for Mayor Morris, four years ago I voted for Mr. Penman. Her behavior at last nights’ city council meeting was reckless, rude and should not be tolerated. I think the general public should have joined the four council members who made a point not to tolerate this behavior.
Over the years I have learned that in politics all you have to do is follow the money trail and I was shocked at what I found when I followed the Arden Guthrie money trail. I went back a few years searched the San Bernardino County Inactive Property Information Management System. I found the records of when the city offered deals on Arden Guthrie four-plex-units to “first time home buyers”. There were certain rules put in place by the city, for example you had to live in the unit for at least one year. I compared names of people that took advantage of this one time deal and found a recurring name, Jerry Martin. Jerry Martin and his wife are heading the Committee to elect McCammacks' hand selected candidate, Jason Desjardins. I bet she won’t “inform” the public about this historic chain of events. I find it interesting fact about your mans', (Desjardins) campaign supporter (Jerry Martin), has profited off of Arden Gutherie when it was supposed to have profited first time home buyers. I find it interesting that Jerry Martin and his wife are actively campaigning for Penman and they don't even live in the city. Now, both Penman and McCammack are still trying to profit off of Arden Guthery by giving false statements. I say Recall Penman, and McCmmack. Put an end to hired guns like the Martins and Chris Jones from interfering in local politics.

First of all, let's get semantics out of the way, shall we? The designations are based upon geographic landmarks. Arden-Guthrie being the area between those 2 N-S Streets and Sunrise-19th St. being the area between those 2 E-W streets.
A-G ends a generous half a block before S-19th begins.
Further, each is offset from the other on the E-W plane.
Think of it this way, you have a square. The square is bisected evenly on the horizontal and vertical planes.
The upper right quarter is A-G - where nearly _500_ low-income units were razed and a vacant commercial lot now stands fenced and HUD approved for commercial retail construction to commence.
The lower left hand quarter of the square is where additional low income units will be both razed and rehabilitated prior to new construction for those of an income at, or inferior to, our area's median ($38,000.00).

Though Penman stated in a recent Press Enterprise, article shared with Mayor Morris, his 20-year frustration with the area, which he pushed City to annex (another of his many blunders), and his inability to come up with a solution to the problem in all those 20 years ("20 years" being Penman's own time stated in the article), and his readiness to just knock everything over and start fresh, (the usual Penman loosey-goosey with taxpayer money approach to everything, from bogus investigations, to grandstanding on public access TV air time, to how to deal with the area we're discussing here - and more), Mayor Morris was able to come in, roll up his sleeves and get a win-win-win solution into ACTION in under 4 years. And, at far less net cost to City than any Penman (unrealized, as usual, scheme).

I'm not saying your candidate of choice didn't try. I'm saying he was incompetent, ineffective and detrimental in his undertakings regarding the area.

First, in pushing for the annexation - that was "his baby" and we all remember the tirades we witnessed until he got his way by achieving annexation of the area.

Second, in pushing for "imminent domain" erroneously, and the $2,000,000.00 the lawsuit over that drained our tax monies.

Third, for malingering "20 years", by his own count in the Press Enterprise article, without providing any solution.

'tis the season, "Three Strikes & You're Out!"

But, we're only speaking of this one area. There are numerous other instances where Penman's follies have wrongly bilked our taxpayer monies.

There were those $800.00 for one investigator to spend one evening in a private room at Flesh Club only to exit empty-handed, with nary a charge to be made for any impropriety. That's the lowest figure I'm aware of.

Then, there were those other $2,000,000.00+ in taxpayer dollars paid not only to the Flesh Club when they successfully sued City for Penman's wrong-doings, but in interest on the initial $1,400,000.00 award + extensive Staff time & farmed out work to Riverside attorneys - the same attorneys he used for his campaign problems last election season, if you shall recall.

Then, there have been all those moments with Penman in the spotlight, such as when he made San Bernardino look like Racism Capitol of The World internationally by concocting the whole Minuteman fiasco in Accounting 101 just to get his digs in at Ruben Navarro.

And, when Penman referred the rape survivor to an attorney in private practice only for that attorney to abscond with the survivor's award money and subsequently be disbarred. That coverage made us look like a bunch of ninnies in San Bernardino, too!

And, of course we all remember Penman's infamous treatment, on official City of San Bernardino letterhead, of the displaced Cypress Mobilehome Park family. Penman's solution to a Latino San Bernardino family in distress? The quote living on in infamy, "If you don't like it, City will provide you a ticket back to Mexico at taxpayer expense, one-way".

And, Mayor Morris is questioned for hiring a PR specialist to come in the wake of Penman's many such buffoonishly bumbling blunders to do damage control and regain our proper place in light of the overwhelming positive impacts his administration has had across our city during his first term? That, in my opinion is "alarming". Not Mr. Anderson's initiation of a recall effort to remove Penman from office once & for all, so that Mayor Morris' second term may proceed with even more vigor, absent the dastardly derailments and detractions of Penman.

Yes, once again the overwhelming majority of San Bernardino's voters will cast their votes of confidence with confidence toward Mayor Morris, and once again Penman will be left on the sidelines, looking up at the dais he hasn't been able to climb in over 20 years of trying, a bitterly dejected reject.

Only this time we're recalling him and being done with once and for all so that progress may, indeed, proceed at the most expeditious pace possible.

Penman's mangled our city for over 20 years now; there's much work to be done to recover from his tenure's misdeeds; we've no room in City for Penman now, nor ever again.

There is a problem in this country's child protection services. Many people are falsely accused of abusing their children and the result is that their children are sent to foster care, a horrible place for most children. If you don't believe me, just google a CPS judge and see if you can find them on the board of directors to a CPS contracted agency. Pull the taxes of the agency and see what they're buying. I wish more people would check into it.

Do you ever wonder why a crack head gets their kids back from CPS? It's because they qualify for certain government grants and programs for reunification so the judges would rather reunify the kids with the crack heads and get that money than do what is best for the kids. Those of us with no drug history or mental health issues don't qualify for these programs so the only way to make money on our kids is to sell them off for adoption. I challenge anyone to look it up and see the truth.

Do you think that is impossible? It's horrible that these judges would be biased and just do it for the money. I didn't want to believe it, myself. I was horrified when I found the truth. It is true. The judges get away with it because there are just enough loopholes in the system for them to slip through.

The judges rarely get cash. The CPS contracted agencies buy things like cars, properties, whatever it takes to bribe the judge. They even get thousands apiece from the county for additional benefits. How could they be unbiased when they are getting money from one party in a lawsuit or another? They'll be partial to the one paying them benefit money. Don't believe me? LOOK IT UP.

I do not stand against the protection of children. If anything, I stand for their protection. There is a REASON that close to 80% of the prison population in California are ex foster kids.

Educate yourselves. Be open-minded and concerned for the welfare of children on a grander scale. Don't ever assume that, just because they're doing it, it's perfectly fine and legal. It's not about what these judges are legally allowed to do. It's about what they can get away with.

Now, how do you feel about Morris' goons going door to door in the poor parts of town where people don't know their rights and are afraid enough of police and CPS to submit themselves to unneeded investigation? Consider all of the children's charities he's involved with. He's not a charitable man. He's not giving them money...I believe he's profiting from them.
