Lopez v Miller: The phone calls
Jude Lopez tipped me off to this case last night. Here's a copy of an email he sent:
Do you remember me telling you about the annoying phone calls that our family had been receiving for the last few months? The numbers were restricted but Verizon traced them at our request and sent them to the police. Some of the calls were threatening but I am not sure if they were traced to him. Here is the information we received from court.

The ex-boyfriend of a woman, who has disappeared with their three kids, was arrested last month for a making annoying telephone calls to the fugitive's father, records show.
Brian Miller, the son of Rep. Gary Miller, R-Diamond Bar, allegedly made harassing calls to Jude Lopez, the father of Jennifer DeJongh, who had three kids with Miller.
The charge, for making repeated calls to "intent to annoy another person at his or her residence," is a misdemeanor.
Dejongh has been a fugitive for several months after disobeying a custody order and disappearing with the kids in November.
Lopez said that he received about 30 calls in the months following Dejongh's disappearance, including three threatening calls.
He said he used a Verizon phone company service to set up the calls to be traced.
Sherrie Davidson, who works in the law offices of Antonio Bestard, who is representing Miller, said that police used the Verizon data as the basis for the charges.
Lopez said he was not sure if Miller was involved in the threatening calls or just calling in and hanging up.
"The threats sounded like they were coming from a disguised voice," said Lopez. "I don't know if it was him, or maybe someone else he knew, or someone else entirely."

Well, I guess since Brian Miller is officially being charged with harassing phone calls then the police have the proper evidence to charge him with a crime. If he pleads guilty does that mean he is really guilty or, "Does he just want to put it all behind him?"
Brian Miller must really be in misery over his boys being gone. So miserable that he makes harassing &phone calls. What a loser.
The real losers here are the Lopez and Dejongh families. It is amazing that the Lopez family has turned the children into pawns and no one seems to see the pain and fear that these two families are putting these children through. The Millers are decent,honorable people and were only acting in the best welfare of these children. It is not difficult to see that the Lopez family are not the most sane or rational bunch. Removing the children from their influence and into the Miller home certainly seems the best option for a healthy life for those three boys.

The boys living with their loving mother no matter where they are... Sure beats a life with a CRAZY, CONVICTED CHILD ABUSER DAD!!! Gary & Cathy Miller are as shady as their whacked out, CONVICT son Brian.

If you look at the facts in the case, Brian Miller has an extensive criminal history including child abuse/endangerment which he plead GUILTY for. A guilty man of child abuse should never be around children.
And your basis for taking kids away from a loving mother is that she is crazy and a liar?
SUPPORTING THE MILLERS - Supports dead beat dads, child abusers, cohabitant abusers, child molesters, and corrupt grandparents.
Definitely the kind of people that should be raising kids...
Get some good legal, concrete facts instead of posting nonsense. And posting the same thing 3 times shows that you are a real moron.
Is it not OK to not support the Millers and yet still think that the Lopez family are crooks too. I can't see leaving those children with Jenny and feeling they are in a good environment. They (Lopez) are not good people and to support them just to spite a politician makes that person just as wrong as the politician they are trying to spite. When there are children involved, you cannot justify supporting losers just to better your argument. If you can do that and still sleep at night, then you should take a good hard look at your morals and character. People had better stop supporting parents and start supporting the children or our system will continue to side with one parent or another with complete disregard for the welfare of the kids. Anyone who knows Jenny knows those kids are not in a good place today. Some of their own family has cut them off for this because they get it. I won’t settle for “well, it’s better than them being with Brian”. That’s a coward’s way of not taking a stand for the kids.
I know Jenny, she raised her kids since birth and has been a good mom. Her boys love her and they have always been in a good loving home. I will take a stand for the kids, they are better off with each other and their mom. This Brian Miller guy and his parents sound crazier than a circus.
I think Brian Miller has handled this pretty well....If these were my children Good old Judas Lopez would have been harrassed EVERYDAY! He knows were the children are! As, a parent my heart breaks for these children. Is Jenny hoping to get a lifetime for woman movie made out of this? She's always saying, she has roles in movies that never happen! I don't know Brian personally BUT, I do know Cathy and Gary. They love their grandchildren!

I hope someone lets us know the outcome of the arraignment on Thursday.I wonder what kind of deal he will make!
The latest on Brian Miller's Superior Court case (harassing and threating calls).He has confessed and he will be sentenced on Thursday morning in Pomona.Details will appear in this paper on Friday or Saturday.
He will probably get 30 days on a cal trans crew and go to counseling to control his anger.
Who cares that Brian called Ju Ju, and hung up on him! Get over it!

I haven't been following this for a while, but 30 days on a work crew sounds pretty good compared to what the mother will get when she's finally arrested. Not too sure about California courts, but in the midwest, mothers (and fathers) get several years in prison for hiding children from the other parent. Remember Kathleen Soliah of the Symbionese Liberation Army? She was on the run for 24 years and they finally caught her. You can run, but not forever.
Yes cornhusker your right,the mother is facing at least 3 years if convicted.As of this moment all I have seen is that there is a warrant for her arrest,no formal charges yet.Even if the DA files and it goes to trial,I believe that you will find at least 1 (or all 12) clear thinking juror(s) that will agree that she disobeyed the custody order to protect her children from an abusive father.

Why doesn't the question about the name change ever get answered? If, this is true....This, sounds like mental abuse! Was it the Lopez family who changed his name? Well purple lion, the idea that a juror would decide it is ok to break the law if they want is scary. So does that mean that anyone who does not agree with a court ruling can just ignore it? it does not matter if someone has a wached out motive in their crazy head, hey still should be held liable for breaking the law. the system will never work if we allow loonies to interpret the importance of an order. In every case you will have someone not happy with the ruling. In your words, that makes it ok to fight the law. Even if you agree with her "why", she still needs to be punished for breaking the law!

Ive been waiting for purple lion to respond to Her fault comment this morning so I will.Thats what jurors must decide,IF a law has been broken or not.That is the basic principle of a criminal trial.Every violation of the penal code has to be proven by the State Prosecutor and the defense has the opportunity to challenge it.Then the jury decides.You and I can each murder someone and your jury finds you not guilty,but my jury finds me guilty.The same act but different outcome.It is our right to fight any charge or any law in court or legislature.Remember Rosa Parks or Jim Crow.In 1965 Mohammad Ali was a convicted felon and top ten most hated American.20 years later he was a national hero.As far as jurors scary decisions,all 12 O.J's jurors decided it is ok to kill Nicole and Ron.I thought it was the wrong decision, but we have to respect it.

No one has ever commented on the effect all this is going to have on the children. They can't be enrolled in school under these circumstances. How can anyone justify that? They must have been told to use different names. How can anyone justify that? It seems as though all the adults in this matter are more concerned about "territory" and spite than the welfare of the children. Someone needs to do a little soul searching and end this farse.
I say that one of these days, one of the children is going to "confide" in a little friend that his real name is "so and so"; that little friend is going to tell their mom and dad; that mom or dad are going to say to each other "something is strange here; then they are going to make some calls to someone else and the 4 of clubs, the 9 of spades and all the rest of the house of cards are going to topple! Exactly! JENNY and her family brainwashed the kids, had them believe their Dad molested them, changed the oldest ones name, and has led them to a life underground. The kids have been fed SO much crap(hatred, ritalin, hospitalizations) in order to build a case against Brian Miller Sr. Jenny has created all this drama. She has put her own needs of having a life with her new husband before those of her sons. Pathetic.

Who is Judas? Who is Brad, who is Gene? I read this story and have no idea these names don't line up with the stories people are commenting on. This sounds like two families attacking one another through blogs and court proceedings. What a sad mess.

Krista, you know why Brian wanted to change his name, its because his worthless father Brian G. Miller abused him. In psychology when a child is abused by his father and they share the same name the child will be reminded of the abuse and will sometimes ask to not be called by the same name.
Oh and I am not a Lopez or a Lopez supporter but a person interested in how a convicted child abuser gets custody.
The comments of these posters reveal a lack of expertise in the area of how family court works. It's simple: report abuse, lose custody. Also, "abuse" has become the crime-lite word to replace criminal activity. Why? It's better for business...and in family court, judges make sure business is always good.

Leave the families alone. Why are we picking on them? It's really none of our business what goes on with this case. Regarding Jude...why do you feel he owes you an explanation regarding his daughter's actions. Regarding the Millers...I'm sure they wish their son was more "upstanding". But these are their children, of course they are going to stick up for them. What decent parent wouldn't! For God sake, leave these families alone. Your negative comments will not make an impact on the outcome of this case. Instead of posting another negative comment why don't you take that time to pray for the children and families involved. Prayer - that will make a difference.
