Former Rams place kicker Tony Zendejas was charged with a felony count of rape by use of drugs, rape of an unconscious person, sodomy by anesthesia and sodomy of an unconscious victim, according to the Los Angeles County DA in a press release issued this morning.

Zendejas, 48,  owns Zendejas restaurant in San Dimas. The press release indicates the victim was drugged and raped in Pomona.  

*Zendejas retired in 1995 after playing 10 seasons with the Los Angeles Rams, the Houston Oilers, Atlanta Falcons and San Francisco 49ers. He was arrested Thursday morning at his home in Yorba Linda.

*The complaint also alleges Zendejas caused great bodily injury.

*If convicted he faces up to 15 years in state prison. Arraignment is scheduled for Friday in Pomona Superior Court.

The undersigned is informed and believes that:

COUNT 1

On or about January 26, 2008, in the County of Los Angeles, the crime of RAPE BY USE OF DRUGS, in violation of PENAL CODE SECTION 261(a)(3), a Felony, was committed by ANTONIO GUERRERO ZENDEJAS, who did unlawfully have and accomplish an act of sexual intercourse with a person, to wit, JANE DOE, not his/her spouse, where said person was prevented from resisting by an intoxicating, anesthetic, and controlled substance, and this condition was known, and reasonably should have been known by the defendant.
“NOTICE: The above offense is a serious felony within the meaning of Penal Code section 1192.7(c).”
“NOTICE: Conviction of this offense will require the court to order you to submit to a blood test for evidence of antibodies to the probable causative agent of Acquired Immune Deficiency Syndrome (AIDS). Penal Code section 1202.1.”
“NOTICE: Conviction of this offense will require to register pursuant to Penal Code section 290 et seq. Willful failure to register is a crime.”

It is further alleged that the defendant(s), ANTONIO GUERRERO ZENDEJAS, inflicted great bodily injury upon the victim, JANE DOE, within the meaning of Penal Code section 12022.8 and causing the above offense to be a serious felony within the meaning of Penal Code section 1192.7(c)(8).

On or about January 26, 2008, in the County of Los Angeles, the crime of RAPE OF UNCONSCIOUS PERSON, in violation of PENAL CODE SECTION 261(a)(4), a Felony, was committed by ANTONIO GUERRERO ZENDEJAS, who did unlawfully have and accomplish an act of sexual intercourse with a person, to wit, JANE DOE, not his/her spouse, where said person was at the time unconscious of the nature of the act, said unconsciousness being known to said defendant.

COUNT 3

On or about January 26, 2008, in the County of Los Angeles, the crime of SODOMY BY ANESTHESIA OR CONTROLLED SUBSTANCE, in violation of PENAL CODE SECTION 286(i), a Felony, was committed by ANTONIO GUERRERO ZENDEJAS, who did unlawfully commit an act of sodomy with JANE DOE who was prevented from resisting by an intoxicating and anesthetic substance and by a controlled substance, and this condition was known, and reasonably should have been known by the defendant.
“NOTICE: Conviction of this offense will require the court to order you to submit to a blood test for evidence of antibodies to the probable causative agent of Acquired Immune Deficiency Syndrome (AIDS). Penal Code section 1202.1.”

COUNT 4

On or about January 26, 2008, in the County of Los Angeles, the crime of SODOMY OF AN UNCONSCIOUS VICTIM, in violation of PENAL CODE SECTION 286(f), a Felony, was committed by ANTONIO GUERRERO ZENDEJAS, who did unlawfully participate in an act of sodomy with JANE DOE, who was unconscious of the nature of said act and this unconsciousness was known to defendant.
“NOTICE: Conviction of this offense will require the court to order you to submit to a blood test for evidence of antibodies to the probable causative agent of Acquired Immune Deficiency Syndrome (AIDS). Penal Code section 1202.1.”
“NOTICE: Conviction of this offense will require to register pursuant to Penal Code section 290 et seq. Willful failure to register is a crime.”

It is further alleged as to count(s) 2, 3 and 4 that in the commission of the above offense the said defendant(s), ANTONIO GUERRERO ZENDEJAS, personally inflicted great bodily injury upon JANE DOE, not an accomplice to the above offense, within the meaning of Penal Code Section 12022.7(a) and also causing the above offense to become a serious felony within the meaning of Penal Code Section 1192.7(c)(8).

NOTICE: Conviction of this offense will require the defendant to provide DNA samples and print impressions pursuant to Penal Code sections 296 and 296.1. Willful refusal to provide the samples and impressions is a crime.

NOTICE: The People of the State of California intend to present evidence and seek jury findings regarding all applicable circumstances in aggravation, pursuant to Penal Code section 1170(b) and Cunningham v. California 2007 U.S. LEXIS 1324.
Further, attached hereto and incorporated herein are official reports and documents of a law enforcement agency which the undersigned believes establish probable cause for the arrest of defendant(s) ANTONIO GUERRERO ZENDEJAS for the above-listed crimes.
