From an FBI press release:

EL MONTE MAN WHO ALLEGEDLY MOLESTED MINORS AND IS
CHARGED FEDERALLY WITH PRODUCTION & POSSESSION OF CHILD
PORNOGRAPHY ATTEMPTED TO WORK FOR LAW ENFORCEMENT

Los Angeles - An El Monte man who was arrested for molesting a minor, has been charged federally with the possession and production of illegal pornographic images of his victim. The SAFE Team (Sexual Assault Felony Enforcement), which includes investigators with multiple state, local and federal agencies, is releasing the man's photograph in order to locate additional victims that may not yet have been identified.

This investigation was initiated when investigators with the California Highway Patrol uncovered alleged criminal activity during a preliminary employment background check. Written responses made during the applicant process led to a CHP investigation of Christian Hernandez, 29, for the alleged molestation of a five year-old child. According to a criminal complaint filed in U.S. District Court in Los Angeles, Hernandez applied to be an officer with the California Highway Patrol in October 2008.
Hernandez admitted on an employment questionnaire that he had accessed illegal pornography on the Internet, and had viewed illicit photos of a minor as recently as one-month prior to applying for employment, according to the complaint.

Hassler, who pleaded guilty in federal court in downtown Los Angeles, could be sentenced to up to 10 years in federal prison.

Alleged child molester enters plea

Gregory Scott Serrano, 33, of Monrovia, entered a not guilty plea at his arraignment Friday in his child molestation and child pornograhpy case, according to officials from the district attorney's office:

PASADENA -- A Monrovia man suspected of luring 10 teenage girls via the Internet to molest them and take pornographic pictures of them appeared in court last week, officials said.
Gregory Scott Serrano, 33, entered a not guilty plea Friday at the Pasadena Superior Court, Los Angeles County District Attorney's Office officials said.
Serrano is charged with 20 counts of child molestation stemming from the alleged molestations, which are believed to date back to June of 2006, said United Stated Attorney Joey Blanch, who is prosecuting the case.
The alleged victims are between 13 and 17 years old, Blanch said.
Serrano allegedly used social networking Web site such as MySpace.com and Netlog.com to meet the underage girls, Blanch said.
He was arrested March 12 after a 15-year-old girl told her parents that Serrano had molested her, officials said.
In addition to the local charges, Serrano has also been indicted federally on suspicion of 23 crimes including using the Internet to entice minors, producing and possessing child pornography and destroying evidence.
If convicted on the federal charges, Serrano could face life in prison, Blanch said.
Serrano is due back in court June 30 for a pre-trial conference, officials said.

Porn free Internet

The federal government wants to sell off a portion of the broadband spectrum to anyone willing to provide free Internet service.

There's just one catch -- no porn.

Measures like this probably wouldn't stop suspected predators like Monrovia's Gregory Scott Serrano from using sites like MySpace or Netlog. And, yes, it sounds an awful lot like something the Communist Chinese might pull. But, on the other hand, it's not much different than the control the FCC exerts over broadcast television.

Here's an excerpt from a PC magazine article on the proposal:

WASHINGTON, May 29 (Reuters ) - U.S. communications regulators are considering auctioning a piece of the airwaves to buyers willing to provide freebroadband Internet service without pornography.
Federal Communications Commission Chairman Kevin Martin is proposing to auction an unused piece of 25 megahertz wireless spectrum, with the condition that the winning bidder offer free Internet access and filter out obscene content on part of those airwaves, a spokesman for the FCC said on Thursday.
"We're hoping there will be increased interest in the proposal; and because this will provide wireless broadband services to more Americans, it is certainly something we want to see," said FCC spokesman Rob Kenny.
Under Martin's proposal, the winner would be allowed to use the rest of the airwaves for commercial services.
The plan would address criticism from some consumer advocates, who say the government has not done enough to get broadband service into more U.S. households. It also could win praise from anti-obscenity watchdog groups.
"I think there are a number of features of the plan that would be attractive to various constituencies," said Stifel Nicolaus analyst Blair Levin.
But the plan got a lukewarm response from existing wireless carriers.

This from the U.S. Attorney's office:

SAFE_-_Serrano_picture.JPGA San Gabriel Valley man was indicted today for allegedly using
social networking sites on the Internet to convince high school-age girls to have sex with him and pose for pornographic pictures.

Gregory Scott Serrano, 33, of Monrovia, was indicted by a federal grand jury in Los Angeles on charges of production of child
pornography, using the Internet to entice minors to produce child
pornography and to meet for sex, receipt of child pornography,
possession of child pornography and attempted destruction of evidence.

The indictment lists 10 teenage girls as victims. However, authorities believe there are other girls who may have been victimized by Serrano.

The investigation into Serrano began in March after a 15-year-old girl reported that Serrano had taken pornographic photographs of her. According to court documents, Serrano posed as a 19-year-old and contacted the teenager after reading her profile on netlog.com and MySpace.com. After courting her via emails and cellular telephone conversations, Serrano pressed the teenager to meet him in person.

Supreme court upholds porn law

| | Comments (2) |

Justice Antonin Scalia writes the opinion in this case, which is known as U.S. v. Williams:

jlm-stars-hollywood-sign.jpgWASHINGTON (AP) -- The Supreme Court upheld criminal penalties Monday for promoting child pornography.

The court, in a 7-2 decision, brushed aside concerns that the law could apply to mainstream movies that depict adolescent sex, classic literature or innocent e-mails that describe pictures of grandchildren.

The ruling upheld part of a 2003 law that also prohibits possession of child porn. It replaced an earlier law against child pornography that the court struck down as unconstitutional.

The law sets a five-year mandatory prison term for promoting, or pandering, child porn. It does not require that someone actually possess child pornography. Opponents have said the law could apply to movies like "Traffic" or "Titanic" that depict adolescent sex.

But Justice Antonin Scalia, in his opinion for the court, said the law does not cover movie sex. there is no "possibility that virtual child pornography or sex between youthful-looking adult actors might be covered by the term 'simulated sexual intercourse.'" Scalia said.

Likewise, Scalia said, First Amendment protections do not apply to "offers to provide or requests to obtain child pornography."

*There's a lot of interesting thought on the First Ammendment contained throughout Scalia's opinion. Here' s a section on the effect of the ruling on "Hollywood:"

Amici contend that some advertisements for mainstream Hollywood movies that depict underage charactershaving sex violate the statute. Brief for Free Speech Coalition et al. as Amici Curiae 9-18. We think it implausible that a reputable distributor of Hollywood movies, such as Amazon.com, believes that one of these films contains actual children engaging in actual or simulated sex on camera; and even more implausible that Amazon.com would intend to make its customers believe such a thing. The average person understands that sex scenes inmainstream movies use nonchild actors, depict sexual activity in a way that would not rise to the explicit level necessary under the statute, or, in most cases, both.
