BP lawsuit threatened
I wrote this story earlier this week.....
BALDWIN PARK -- The proponents of a recall effort are threatening to sue the city clerk over a technicality that killed their initiative.
A letter sent to Susan Rubio last week warns she should "be prepared to defend (her) actions in court," unless she rescinds the earlier decision to reject the recall papers against three City Council members based on election code violations.
Rubio -- who is an elected official -- could not be reached for comment Thursday.
Local businessman and Pomona resident Greg Tuttle initially served recall notices on Anthony Bejarano, Marlen Garcia and Monica Garcia in June.
The proponents accuse the trio of mismanaging the Police Department and criticize Bejarano and Marlen for their support of a downtown redevelopment project, among other grievances.
But the city rejected the effort because two sets of documents were not filed at the same time, as cited in the state election code, Deputy City Clerk Laura Nieto said.
Proof of publication of the recall notices served on the three council members were submitted to Nieto on July 1 and placed in a file. On July 10, Tuttle filed blank copies of the proposed petitions intended for circulation. According to the election code, "at the time of the filing of the two blank copies of the petition, the proponents shall also file proof of publication."
Officials said Tuttle did not ask that all the documents be combined when he filed the petitions.
"All they had to do was pull the papers out of the file and put them together," Tuttle said. "It was all there. Now they are claiming it's all null and void and I have to start over again."
Nieto said the city is "just going by what the election code says," and it was not the city clerk's job to take previously filed documents and attach them with the proposed petitions.
Tuttle called the move a delay tactic, and accused the city of trying to trump the recall effort.
In the letter Pasadena-based attorney Christopher Sutton sent to Rubio on Sept. 3, Sutton calls the reasoning "a fraudulent excuse to reject these petitions. This rationale is ridiculous and merely a smoke screen..."
Sutton, who is representing the proponents, also accused Rubio of potentially violating civil rights and voting rights.
"Do not protect these three council members...Do not become a part of their disreputable group or follow them into a pattern of unlawful conduct," the letter states.
Sutton did not return calls seeking comment Thursday.
"(Rubio) had a really bad city attorney directing her course of action," Tuttle said.
City Attorney Joseph Pannone confirmed his office was consulted before the decision was made. He called the final determination "proper."
He also said Wednesday the city had not responded to Sutton's letter, nor had he be given direction to respond.
"That letter from that attorney is long on bluster and short on facts," Councilman Anthony Bejarano said. "If they sue, that just demonstrates their interets are purely their own."
Tuttle said if Rubio does not rescind the decision in the coming weeks, they will file a civil lawsuit against her only, because "she is personally responsible."
"Obviously, they have questions about the actual process itself," Mayor Manuel Lozano said. "They have the right. I have confidence in the city clerk's office that they are doing the right job."
God, Tuttle is the biggest moron in the SGV! It's clearly not the job of the City Clerk to put his recall package together. This idiot can't even follow directions on something as serious as the recall. I'm just glad he found an attorney who is going to charge him an arm and a leg for his stupid mistakes. At least he'll learn something that way.
If the law says you have to do something a certain way, and you fail to do it, how is the city playing games? Should they just waive all the requirements just b/c tuttle thinks he's right? Does he get a special pass under the americans with disabilities act?
Tuttle, needs to get a life! LEave the city of BP alone! Move your horrible business out of BP and take it to your hometown of Pomona! Seriously, if you are not happy there, why stay there?
To the unimformed and uneducated the papers where done properly but when you have a crooked council thats afraid of the recall what do you expect. Why doesn't anthony be a man like he said he was and let the people vote on the issue. I think they are all afraid because the police got all the votes they needed on their issue and if the recall goes thru their redevelopment is down the tubes. Let's not forget the games the city played on the police when they submitted their votes to the city clerk same games. If the recall so stupid why are they scared to let it go to the voters.
It's not that the Council is afraid of an insignificant speck such as yourself, Tuttle. Why would they be? You're so stupid you can't even file recall papers correctly. Way to get the process rolling buddy. The Council has nothing to be afraid of if you're it's main adversary. You're a pathetic joke, and it's no surprise your recall is a failure, just like you.

Tuttle is right and for the record city council officials are well paid $40.000 a year to screw the citizens of BP not counting cash under the table from developers. did any of you guys up there also in the pay roll of Bisno, Muruello & Madux or the cook brothers, DC Corp? in regard to city clerk it is what it is, let the court dictate the undersatnding of the rules. And for the mad young squire that knowllage is only a finger higher over his head than some people; Show some respect or go back to GW so you can continue your education

The rules say the papers had to be filed at the same time. You're quoted in the article as admitting they were not filed at the same time. So the papers weren't correct. Get over it and refile cleetus.
I heard that tuttle filed all those recall papers with all those special comments because when your dealing with losers and idiots you need to speak to them on their level sushi man. Why are you afraid of a speck taking you losers down let the recall go through and the you can resign and bisno can pack his bags. Someday anthony you will need to grow up and admit your a loser as a councilman and a out of your house attorney. Hey here's a thought get your guard testing and you and the mayor can be security guards at marlens hospital. Read up on how lynwood played with the recall papers and what happened on who paid attorney fees and court costs when they played the stupid games the council is playing.

You misspelled incapable, buddy. That being said, I agree that Tuttle can't seem to do anything right and that he should stay in Pomona and quit causing such a ruckus. I say this for his own sake; he's going to end up quite embarrassed (and broke after lawyer fees) once this is all over.

I have to admit that I am a little curious to hear your thoughts on the Bejarano story that came out over the weekend.
I put in the Women... just for you Brandie. Smile. I got the word by someone that was nearby and said you could tell he was acting buzzed. I'm pretty sure he was feeling no pain when he got popped. It was real bad luck for him that night. He's young and OK he's not perfect. I'm sure that won't repeat itself cause he's just not that stupid. What i don't like is Pacheco running his mouth like that. I actually have found Pacheco amiable in the past but lately i find his actions suspect. He's up to something and it doesn't look good.
