Nothing is expected to happen with safety Josh Pinkard's DUI case until after football season begins.
A DMV hearing's been continued and no court hearings are scheduled yet.

Why would it be considered a DUI at .076?

One can be cited for driving while slightly impaired, even if its under the .08 DUI threshold, especially where the vehicle was not being operated safely (e.g., weaving or speeding). Indeed, Tank Johnson, formerly of the Bears, was arrested for driving while slightly impaired, and the test results showed he was under .08 BAC.

The D.A. has the discretion to not prosecute the case. With a public figure, however, a lack of prosecution may be deemed preferential treatment. Class dismissed.

CSTORY80; uscmike is 100% correct----tho I must confess I was thinking of rounding--like .0751 comes out .08? Don't they do that? I have no experience-ha ha!
