Mayo Fallout
The Penn State Institute for Sports Law, Policy, and Research published a paper today on the O.J. Mayo case and the potential liability. Among its findings, ``the Pac-10 Conference may be required to refund or forego a substantial sum of money that received because of USC's success in the Men's Basketball Tournament this year.
Also, ``Agent Billy Duffy and his BDA agency are potentially liable to USC under federal sports regulatory law and California law if USC suffers any financial damage as a result of the scandal.''

USC needs to take civil action and against Guillroy and Johnson too, if they can.
The same should be considered in Bush case if losses occur.
Penn State Institute for Sports Law. Hmmm, I wonder if they ever have bothered to take a look in their own back yard. Of course not, I mean why would they want to tarnish that brass rocking chair the Joe grand-Pa sits in. Fight On!
Wow, that was a mouthful.
And so Mayo could have civil AND criminal liability. Criminal if he lied on his application to SC that he was eligible i.e. had not received any gifts or money for his talent, and then sent the application via interstate mail (mail fraud). And he might have to pay SC restitution money if SC forfeits the monies it received for its appearance in the 2008 NCAA tournament (which Mayo participated in).
More alarming, for SC anyway, is that there is an affirmative duty to check out athletes who apparently have received expensive gifts i.e. Mayo's big screen t.v.
This seems problematic to me because it would be hard to prove. Mayo could say it was a gift from his family, or he had saved up for one, or he bought it with a small down and was making monthly payments. Also, how often do coaches go trooping through students' dorm rooms?
Anyway, it was an enlightening article if you are into law.
I can just imagine the PSU law geeks began plotting this, thier ultimate revenge, right after we thrashed them in the Rose Bowl.

Yes, USC should sue BDA to Kingdom Come!!! You could argue that monetary damage to next season's hoops revenue has already been inflicted just based on the allegations and fallout therefrom.
Why are you guys banging on Penn State? Let's face it, our program has welcomed sleaze, so let's clean it up, pay the penalty and win clean under the next administration.
