Lane Kiffin said today in New York he was surprised the Titans are suing him according to the Associated Press.
``(It) was done no differently than any we did at SC or Tennessee. I didn't anticipate this. No one would have.''

The breach is with Pola, since he signed the contract and it's not like anyone held a gun to his head. So really the major question that remains unanswered --and Wolf does not bother to ask or analyze -- is exactly what do Fisher & Titans stand to gain and why the fuss? Are they doing this for publicity, bruised ego, maybe even simple revenge.

The reason the Titans aren't suing Kennedy is that they allege that USC "induced" Kennedy to violate his contract. This is a separate claim from what actions they may take regarding Kennedy. But as any attorney knows, bigger pockets are the better target. It will be difficult to prove damages but I suspect they are looking for a quick settlement and, more importantly, headlines.

Shortly thereafter, Kiffin and USC persuaded four more University of Tennessee coaches — Monte Kiffin, Ed Orgeron, James Cregg and Willie Mack Garza — to leave the University of Tennessee to assume employment in coaching positions with USC. Upon information and belief, USC and Kiffin also attempted to hire for USC a running backs coach, Eric Bienemy, who was under contract at the time with the National Football League team known as the Minnesota Vikings. USC and Kiffin were unsuccessful in persuading Bienemy to end his relationship with Minnesota, but upon information and belief, Minnesota was forced to renegotiate Bienemy’s salary to its detriment due to Kiffin and USC’s acts of interference.”

So let me make sure I have this right: Kiffin is legally at fault for exercising the buyout option in his UT contract? And he’s in the wrong for trying to hire currently employed assistant coaches — which happens every day in college football and the NFL?"

It was Pola's job to abide by the conditions in his contract and seek permission - if required - to speak to USC, AND to communicate that condition to USC if it was not known. The way this "lawsuit" sounds - haven't seen it - is like USC intentionally lured Pola to take a job saying essentially "to h--- with your contract" we want you so talk with us, "we won't permit you to get permission to talk to us". That is absurd. These situations arise daily in the football world, particularly at this time of year. Is Pola named as a defendant for breaching his contract, and if not, why not? Don't want to hurt him, or stir the pot, but it would seem that that was a necessary claim here... just saying....!!! If the contract wasn't breached, then where's the claim against USC?
